An illegal immigrant from Senegal, who is wanted for three sexual criminal charges in New York City, has been arrested trying to slip back into the county unlawfully in Orleans County, officials said.
Khadim Ndaiye, 29, formerly of Brooklyn, N.Y., appeared briefly in federal court in Burlington on Friday afternoon to face a criminal complaint filed by the U.S. Border Patrol for illegal entry into the Northeast Kingdom on Wednesday.

Magistrate Judge Kevin J. Doyle ordered Ndaiye detained pending further hearings in Burlington.
A fingerprint check by the Border Patrol revealed that Ndaiye has an arrest warrant from the New York County Criminal Court for charges related to three sex crimes stemming from a September 1, 2025 arrest, records show.
He is wanted for forcible oral sexual contact, forcible touching sexual/intimate parts and sexual misconduct involving contact without consent, the criminal complaint said.
First Assistant U.S. Attorney Jonathan A. Ophardt praised the ongoing investigation of the Border Patrol.
“I am extremely grateful that Border Patrol Agents worked tirelessly to locate and apprehend Ndiaye after his alleged unlawful crossing. Ndiaye’s immigration history and pending criminal charges in New York State underscore the vital importance to securing our northern border with Canada,” Ophardt said.
The Border Patrol attempted to interview Ndiaye after his arrest, but he declined to speak without a lawyer present, court records show.
Immigration records reveal Ndiaye departed the United States on September 15, 2025, about two weeks after his New York state arrest.
Now the U.S. Border Patrol has intercepted Ndaiye unlawfully crossing back across the international border onto Bear Mountain Road, near Mud Creek bridge in North Troy on Wednesday afternoon, court records show.
It is about 830 yards south of the International border and the closest Port of Entry for reporting was 2.8 miles to the west.
Border Patrol Agents said about 5:30 p.m. they observed foot tracks and indicators of people moving through the woods. After following clues, agents observed a man from a distance hiding in the tall grass initially along the side of Mud Creek, they said.
As agents approached the man, he began to run and evaded them. Agents continued to search the area for several hours. They eventually located a man about 11:30 p.m. near Vermont 105 wearing the same clothes as the person detected improperly crossing the border, the Border Patrol said.
Ndaiye’s clothing was covered in brush and mud, indicating he had likely been in the woods for an extended period, a Border Patrol agent said in a court affidavit.
Ndiaye’s fingerprints were used to identify him as a citizen of Senegal, records show. He had previously been apprehended by U.S. Border Patrol in 2023 in San Luiz, Arizona while illegally entering the country.
At the time, consistent with 2023 border policies, Ndaiye was issued a notice to appear for immigration proceedings and released into the country.
Records show he left the United States on Sept. 15, 2025, the Border Patrol said.
This week during the processing of Ndiaye, Border Patrol Agents at their Newport station found a belt that still had a sales tag on it with a Canadian identification number, records show.
“The United States Attorney’s Office remains committed to working closely with our federal law enforcement partners to ensure that those who evade our ports of entry are apprehended and prosecuted,” Ophardt said.
Vermont has seen a large uptick in the number of federal criminal cases being prosecuted following apprehensions of illegal immigrants in Grand Isle, Franklin, Orleans and Essex Counties.
Ophardt said the Ndiaye criminal case is part of Operation Take Back America. It is a nationwide initiative that marshals the full resources of the Department of Justice to repel the invasion of illegal immigration, achieve the total elimination of cartels and transnational criminal organizations (TCOs), and protect our communities from the perpetrators of violent crime, he said.
