McClaughry: Biden says “we” must control Supreme Court

President Biden signed an executive order directing agencies to take steps to protect access to abortions and the privacy of patients seeking reproductive health services. The order also directed the Secretary of Health and Human Services to make reports and launch a public education campaign on access to reproductive health services.

I’m not taking a position on the merits of the Supreme Court’s decision, or the effectiveness of the actions President Biden announced in response to it. But there’s one thing the President said when signing the executive order that really aroused my concern. Here it is:

“We cannot allow an out-of-control Supreme Court working in conjunction with extremist elements of the Republican Party to take away freedoms and our personal autonomy,” Mr. Biden said before signing the order.

The bit about the Court working with extremist Republicans to take away our freedoms and our personal autonomy is the usual kind of partisan that ought to be beneath the dignity of a President, but that’s not my big problem.

My big problem is Biden’s declaration that “we can’t allow an out of control Supreme Court….” Oh? Who is this “we”? Just who is supposed to be in control of the Supreme Court? The President? The Congress? Not under our Constitution that you repeatedly swore to defend, Joe.

  3. With regard to John declaring: “I’m not taking a position on the merits of the Supreme Court’s decision,”….

    it is worth mentioning that the Tenth Amendment (in the Bill of Rights) to the US Constitution states in a quite declarative manner the legal foundation upon which the legal system in this country operates:

    “The Powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.”

    There is no doubt that SCOTUS correctly interpreted the law.

    The fact that a majority of Americans believe that abortion should be allowed under a specific set of guidelines means that it is up to the people in 50 States to make their voice heard as to what laws and policies will govern abortion in this country.

    Those who gave birth to this country via the Declaration of Independence and the US Constitution (with the Bill of Rights) understood the dangers of investing unlimited power in one branch of government… so they created checks and balances with one branch created to act as referee to arbitrate whether laws and policies enacted abided by the documents that established the legal foundation of this country.

    The greatest danger is when politics and/or majority public opinions drive decisions made by SCOTUS… because politics and majority opinions change all the time. SCOTUS does correct egregious legal decision errors made in the past, and that is to its credit when the past decisions were not aligned with the principles outlined in the country’s founding documents.

It should come as no surprise that Biden and his fellow democrat authoritarians refer to SCOTUS as “out-of-control.” It is abundantly obvious that modern democrats view any policy or power structure not in agreement with them as illegitimate. Modern democrats call those who object to their despotism “fascists” even as they themselves exhibit the very characteristics of fascists. They count on the ignorance of an easily manipulated public, an alarming number of whom cannot name a single SCOTUS member, or even their own congressperson.

  5. More insidious and dangerous babble from this Installed Administration. These Marxists (who are pulling the strings on this sad, aged and incoherent President) don’t care about the Constitution and Bill of Rights. They most likely scoff at the Federalist Papers. They are only concerned with advancing the progressive project. They are insidious, like termites invading a wooden framed house. They gnaw away at the structure until it collapses. They are dangerous, and they grow by conscripting ignorant, non thinking people who have been conditioned to accept their nonsense. Unfortunately, that happens to be many Vermonters. Current conscripts also include most of the graduates of higher education who have been taught that the left is the way, the truth and the light. It’s a religion to them. I don’t have much faith in Vermonters sending these Marxists at the State level packing. But, I have optimism that the citizens in the other States within our Republic will help fix this in November.

  6. No wonder young people (aged 40 & under) haven’t a CLUE of what the branches of government are and how they work. Apparently, even according to this ding-dong of a “president” – he and the other branches of governance are there to “control” the Supreme Court who sit there and just look all official in their black robes et al.

    Interpreting the US Constitution & its amendments? What’s that again?
