In Prospect St. shooting letter, mayor calls for gun ban in bars

In response to the shooting of three Palestinian men Saturday and the rising gun-related homicide rate in Burlington and Vermont, Mayor Miro Weinberger yesterday again called for legislation to ban guns from bars “and other sensitive spaces.”

Also, a letter from one of the three victims of the shooting was read at a vigil at Brown University Monday night. In the letter, junior Hisham Awartani expresses support and solidarity for the Palestinian people in their conflict with Israel. 

“I am but one casualty in this much wider conflict,” Awartani said. See extended excerpt below. Doctors expect a long recovery from a gunshot wound to his spine. Jason Eaton, 48, a financial services worker and Burlington resident, was arrested Sunday at his North Prospect Street home for the shooting of Awartani and two other college students. As yet no motive has been announced by police. State’s Attorney Sarah George said there is at present no evidence to declare the shooting a hate crime. 

At present, state law allows firearms to be carried anywhere in Vermont except schools, courthouses, and federal buildings. 

In January, Weinberger and lawmakers from the city called on Montpelier to pass “statewide gun safety laws, including; requiring the safe storage of firearms, prohibiting guns in bars, restaurants, and other sensitive spaces, making reckless endangerment with a gun a felony, and funding gun violence research.”

Burlington has a thriving downtown bar industry. In recent years there have been several shootings in bars and on the street outside, most of it by people with drug crime records. However, the majority of recent shootings have occurred away from the bar scene.  Prospect Street is at the height of the “Hill Section” of Burlington, many blocks away from downtown.

The June, 2022 U.S. Supreme Court Bruen decision severely limited the constitutionality of state law banning firearms possession outside of the home. 

Also, Chittenden County prosecutors have a spotty record of enforcing existing gun laws, Vermont gun rights advocate Chris Bradley wrote in the Chronicle this week: “Let’s look at another law, committing a felony while carrying a weapon (13 VSA § 4005). This law states that a ‘a person who carries a dangerous or deadly weapon, openly or concealed, while committing a felony shall be imprisoned not more than five years or fined not more than $500, or both.’ According to 2021 court data: There were ZERO active cases, ZERO dismissed and ZERO guilty of that offense in Chittenden County. 2022 court data for Chittenden County shows 1 active, ZERO dismissed and ZERO guilty.”

Weinberger’s comment appeared in an open letter to Burlington residents, issued yesterday and published in its entirety in the Burlington Daily News. A lengthy excerpt appears below:

I hope that this shooting is the last one in what has already been the violent year in Vermont’s history. Statewide, we have seen ten homicides and one suspicious death since October 1, which includes the double homicide in Burlington on November 12.

Burlington has had 16 gunfire incidents so far this year, and we are not alone in Vermont – many communities are experiencing an alarming rise in gun violence with recent shootings happening in Newport, Danville, St. Johnsbury, Brattleboro, Castleton, Leicester, Brookfield, and last week a road rage incident ended in gunfire in South Burlington.

This is unacceptable. No other country accepts gun violence like this, and neither should we.

The new legislative session is now weeks away, and I will keep fighting for gun safety laws that Burlingtonians support and have been asking for for years.

I will be calling again for new legislation to ban guns from bars and other sensitive spaces, to make reckless endangerment with a firearm a felony, and to better fund statewide research on gun crimes and gun violence. Awartani’s expression of solidarity with the Palestinian struggle against Israel was read to a large crowd of Brown University students Monday night, shortly after they had booed the college president off the stage. Excerpted from the Nov. 30 Brown Daily Herald, the student newspaper for the Providence, R.I. university:

Professor of History Beshara Doumani, who had visited Awartani in Burlington with Vice President for Campus Life Eric Estes, read a message from Awartani to the crowd:

“It’s important to recognize that this is part of the larger story. This hideous crime did not happen in a vacuum,” Doumani recited. “As much as I appreciate and love every single one of you here today, I am but one casualty in this much wider conflict.”

“Had I been shot in the West Bank, where I grew up, the medical services that saved my life here would likely have been withheld by the Israeli army,” Doumani continued reciting, met by cheers and applause from attendees. “The soldier who shot me would go home and never be convicted. I understand that the pain is so much more real and immediate because many of you know me, but any attack like this is horrific, be it here or in Palestine.”

“This is why when you say your wishes and light your candles today, your mind should not just be focused on me as an individual, but rather as a proud member of a people being oppressed,” Doumani concluded.

After sharing Awartani’s statement, Doumani reiterated students’ calls for divestment.

  1. Two thoughts. The first is that as usual the left is trying to take away more of our gun rights under the guise of “safety “. In truth, nearly all of the shootings here have involved drugs, felons, out of staters and the like. Adding more places to the list of those where guns are prohibited will do nothing for safety. And do you honestly think gun toting felons dealing drugs care about your laws?

    As for the young Muslims shot the other day, I guess it’s not surprising what they think and who they side with.

  2. The communists don’t go for the criminals. In fact, they encourage them. They’re only criminals because you oppressed them! Then they go for you, because you had the audacity to fight back. It’s always the same tactic and it’s meant to break your spirit, and completely demoralize you. Import and facilitate more violent criminal elements, disarm you in public places, and selectively prosecute based on an imaginary hierarchy of oppression. Communist Anarcho-Tyranny 101.

  3. It all comes down to enforcement. I’m not for people carrying guns in bars but the number one thing Vermont needs to do is crack down on drug offenders, especially those from out of state.

  4. There it is: Government call to ban guns. What if a gun wasn’t available to someone who wanted to kill ? Would there be other means to commit the crime ? You Bet ! It’s not about guns, it’s about systematically dismantling the 2nd amendment of the Constitution. We can’t I WILL SAY IT AGAIN We can’t have a Constitution in a Socialistic Government. WHY, because in a a Socialistic government the government rules. In a Constitutional Republic, the people rule. That is what our Constitution is all about. It works in two ways:
    1) It is a job description to those who are voted into office on what they can / can not do.
    2) It is a guide to all citizens to your full rights under the Constitution.
    They want to take your guns, and that happens by adding places you can’t exercise your constitutional rights. One at a time until the only place you can exercise those rights is inside your home. Step outside your door, and then those rights don’t apply.

    • As evidenced by the gun owner who had firearms stolen from his house by a couple of juveniles, even your own domicile is not immune to the left’s hair brain anti Second Amendment crusade. The frightened little people under the Golden Dome now have infringed, and put conditions on our right to keep, and bear arms in your own home. They need to go !

  8. Miro: “Remember this problem that I helped create while Mayor of Burlington?”

    -Voting to be a sanctuary city (allows all the drugs in)

    -Lowering the number of police in Burlington (no way to enforce laws)

    -Raising taxes (making people poor which is the 2nd leading cause of crime)

    -Putting tax money towards climate change that doesn’t exist (making people poor)

    -Sarah George catch and release programs (not prosecuting criminals when they are caught)

    Also Miro: “Yeah forget about all that but we should take your rights to solve the problem.”

    All of that happened on his watch and he wants to take a higher office.

    Personally, I think he should be sued for ruining a city.

  9. Miro is a disingenuous d-bag ! He’s not just in favor of banning guns in “bars, and other sensitive places” that would just be his first decree, if he could. If he really wanted to affect crime, he’d go on record, and request to get rid of Sarah George, and the rest of the “catch, and release” crowd, but he does not do that, he tries to divert attention by utilizing the answer to all crime, (sarcasm) guns. He then shuts his mouth, and does, and says nothing to actually address the problem The silence coming from Miro regarding drug adeled mentally defective criminals, the real problem, is deafening .

  11. …and the logic is what? Criminals break laws. Only law abiding people follow them. Work on caging the criminals effectively and efficiently. I think that will slow down your “gun violence” which really is “societal violence” ignored too long. The free people of the state/country are not the problem.

    The US ranks 59th in the world for intentional homicide by firearm. And it’s almost all concentrated in one demographic, without which the US would be as safe or safer than most of Europe… used to be.

    • We certainly can’t fix it if we really can’t even talk about it, and I don’t think that’s accidental. Certainly the left is quite happy to take advantage of it in their Machiavellian quest for power. When they say “by any means necessary,” they mean it. And their indignant cries for justice certainly ring hollow in this regard.

  13. I would like to see this past years list of shooters in Vermont and their profiles. This might help the group think crowd to increase their analytical skills before jumping to take away rights from good law-abiding citizens. The reason for all these shootings is because there are no consequences anymore. Too few police to manage the level of crime (also brought to you by the group think crowd) and rampant drug use along with insufficient mental health services.

    no real facts, maybe the Mayor should try cleaning up the cesspool he and his cronies
    produced, debt, crime, drugs, homelessness. Hey Mayor how many of the shootings happened in a bar, the answer is non, all scumbags up from the cities from our neighboring states, more feel-good, liberal anti-gun nonsense !!

    Vermont, Miro wants to be your next Governor, yeah let’s turn the whole state into the same cesspool Burlington has become ………………………………………..

  15. This isn’t Tombstone circa 1881, with bar room, poker games settled by a gun fight.

    There was a time when rational Vermonters detested being played for a fool. Weinberger shrewdly understands that time has past. That elections, ordnances and legislation are won based on emotional appeal to Vermont’s simplest minds.

    If Vermont is to survive we must recruit candidates for office with superior judgement.

  16. If Miro gets his way, only the (way too many) Burlington drug dealers will have the guns. But look on the bright side, maybe the two social workers that arrive on the crime scene will have EMT training.

    Miro and his “bars and other sensitive spaces” remark, or the subjective reasoning of Beshara Doumani stating that, “Had I been shot in the West Bank, where I grew up, the medical services that saved my life here would likely have been withheld by the Israeli army”.

    Are we to conclude that a “sensitive space” might be a bedroom?
    How much stupidity must we endure from the left regarding gun free zones? As for Hamas/Palestine conflict – when Israel gives back three terrorists in return for a four-year-old child, who actually is the greater savage?

    Every day Israel withholds their cleanup operation another day, Hamas prepares for the slaughter of noncombatants as witnessed today in Jerusalem, by the two Palestinians brothers who gunned down two unarmed women and a civilian male. Hamas took credit for it – so much for the ceasefire ….

    Do you want gun control Miro?
    Two off duty IDF’s and an armed civilian took those two perps down.

  21. There are probably far more people senselessly killed by those at the bar who have car keys in their pockets than by those who have guns in them.

    If we start legislating firearm restrictions in bars, to be consistent we will have to start legislating knife restrictions, box cutter restrictions, and automobile restrictions. Wait, we already have laws on the books which prohibit people from stabbing people and from driving drunk.

    It seems that those who are going to break the law, especially those who have had too much to drink, have already proven that they don’t respect the law, as in DUI #2, #3, #4, #5. Do these politicians really believe that the answer to stopping illegal behavior is to have the government throw more money at it for “research?” Eventually, they would control every aspect of our lives with the false notion that this will make us a moral people. Their line of thinking makes as much sense as legislating how we store our firearms in our own homes so that we won’t commit suicide with them. Again, to be consistent, they will have to start legislating locking up the contents of our liquor cabinets so we won’t commit suicide with or kill others with them.

    We either trust people to use common sense and common decency, or we don’t. In our constitutional republic, we trust people to be responsible to employ the human dignity of free will and liberty for good, and those who demonstrate the least internal controls to respect others go to prison where they must then have the greatest external controls imposed on them. The totalitarian state, however, would lock us all up to impose controls on every aspect of our lives because it recognizes nor respects neither human dignity nor liberty. The result is absolute power and tyranny. How’s that worked out for civilization?

    As Thomas Jefferson said, “I would rather be exposed to the inconveniences attending too much liberty than to those attending too small a degree of it.”

Vermont has the best gun laws in the country and the rise in gunfire in Burlington is a direct result of idiotic democrat policies. Guns don’t kill people, people kill people, and when you let the wrong kind of people spit at the law, and let moronic and corrupt prosecutors and judges put them back on the street, when feds fail to deport them, then what you have is communism and dictatorship.
    Today I heard a comment by Elon Musk who has been set upon by the criminals at the media matters crap site:
    “What I care about is the reality of goodness not the perception of it. And what I see all over the place is people who care about looking good while doing evil.”
    Trying to look good while doing evil is a good description of not only Miro Nothingburger but of every stinking democrat in Vermont.

    • These lefties, of which Nothingberger is one of, never quit. For everything they do, and accomplish, there is always a next step until they reach the goal which in this case, is confiscation of legally and lawfully owned firearms that I own and every other person owns. That is the goal, there is no argument about that and they will wait one or two generations if they have to. There were not enough lefties here 30 years ago to accomplish much, particularly in the firearms area, so they imported people like Baruth, LaLonde and others who would ultimately be elected to the Legislature and turn the tables. The rest is history. Thank goodness for people like Chris Bradley, Eric Davis and others who have done yeoman’s work in keeping the results of their work to a minimum, with the help of Vermonters (native) to pitch in. The next 10 years will not be easy as these carpet baggers have a lot of money behind them, Bloomberg for one and they are willing to spend it to finish taking over the state. We are at tipping point time and there is no question about that.

  23. People need to pay attention to what the demon crats and their media brothers and sisters now refer to as “mass shootings”. A gang banger shooting into a crowd of other gang bangers is now labeled as a “mass Shooting”. Nope. Husband kills wife and kids. Mass shooting. Nope. Domestic violence. FBI has reclassified these shootings into “mass shootings”. This way, the numbers of “mass shootings” show a significant increase, hence more ridiculous anti gun legislation that won’t amount to anything.
    I’m 64 years old. For the past 50 years I’ve heard demon crats preach about how they will handle crime if elected. How they will handle poverty if elected. How I’ll handle homelessness if elected. 50 years of failed proposals and policies. Republicans not much better. As a nation we are beyond the need for a third political party in this country.

While I’d be the first to admit that a night of drinking while packing is probably not the best idea, I would not support prohibiting it legislatively. How would this have prevented the NY drug cartel execution of two young men who took the wrong step or the three guys on the street from an obviously disturbed individual??? Marxists are endlessly creative in their tactics to pit the general population against one another, while at the same time deviously conspiring to disarm the same so as to make the diabolical tyrannical takeover that much easier…sorry, but I refuse to make your plan to make my constitutionally protected right to keep myself safe from assaults successful. When you make my right a crime…I guess I’ll be a criminal.
