‘Dad said no,’ but school vaxxed student anyway – and VT Supreme Court backs them up

A U.S. law governing vaccination in a public emergency protects a Windham school district from lawsuit even though it administered a Covid-19 vaccination to a student without parental permission – and even when the student himself said, ‘Dad said no.’

That’s the upshot of a July 26 ruling by the Vermont Supreme Court. The court’s decision could send the question of the scope of parental rights in child vaccination to the U.S. Supreme Court. 

The ruling, Dario Politella and Shujen Politella v. Windham Southeast School District, concluded Vermont court action resulting from a November, 2021 incident (as reported by Vermont Daily Chronicle) in which a first-grade student at the Academy School in Brattleboro was injected with the Pfizer BioNTech single-dose drug for Covid-19 at a school clinic against the expressed will of his parents. 

Principal Mark Speno admitted in a letter to parents a day later that “in the course of vaccinating students at this clinic, a mistake was made. A student whose parents did not consent to vaccination was mistaken for a student whose parents did consent. We are deeply sorry that this mistake happened, and have worked internally to improve our screening procedures.”

Sorry and we’ll try harder didn’t cut it with Dario and Shujen Politella, the parents of the child. They filed suit. A lower court dismissed the complaint for “for lack of subject-matter jurisdiction,” the July 26 ruling said in its review of the facts of the case.  

The Vermont Supreme Court summarized its ruling with this sentence: “We conclude that defendants are immune from suit under the Federal Public Readiness and Emergency Preparedness Act (PREP Act).”

The PREP Act was enacted on December 30, 2005, as Public Law 109-148. It addresses liability immunity and creates a compensation program. Critics of Covid-19 vaccine mandates say the law offers too much protection for big Pharma and for government agencies and staffers administering vaccine programs during public health emergencies. 

According to the federal Department of Health and Human Services website, “The Public Readiness and Emergency Preparedness Act (PREP Act) authorizes the Secretary of the Department of Health and Human Services (Secretary) to issue a PREP Act declaration. The declaration provides immunity from liability (except for willful misconduct) for claims:

  • of loss caused, arising out of, relating to, or resulting from administration or use of countermeasures to diseases, threats and conditions determined by the Secretary to constitute a present, or credible risk of a future public health emergency, and 
  • to entities and individuals involved in the development, manufacture, testing, distribution, administration, and use of such countermeasures

The Academy School employees would seem to fall under the category of “administration and use” when they vaccinated L.P. over his and his parents’ objections.

According to their lawsuit, the Politellas lived in Brattleboro with their son, L.P., who was six years old in 2021. L.P. attended Academy School in the Windham Southeast School District. 

The couple described what happened this way (printed virtually verbatim from lawsuit):

The Vermont Department of Health and the school district entered into an agreement to host a COVID-19 vaccination clinic at Academy School in November 2021. Students needed parental consent to be vaccinated. The Politellas did not consent to have L.P. vaccinated. 

A few days before the clinic, L.P.’s father dropped off L.P. at school and spoke with Academy School’s assistant principal. He reiterated to the assistant principal that they did not consent to have L.P. vaccinated. The assistant principal said that he understood and stated that L.P. could not be vaccinated without plaintiffs’ consent. In the same interaction, the assistant principal said that the school had not received as many vaccine registrations as he would have liked.

Despite the above, L.P. was vaccinated on the day of the clinic. An unidentified worker removed L.P. from class and applied a handwritten label to L.P.’s shirt that read, “L.K.” and displayed “L.K’s” date of birth. L.K. was a five-year-old student at Academy School who was not in L.P.’s class. L.K. had already been vaccinated the same day. L.P. “verbally protested,” saying, “Dad said no.” 

Nonetheless, clinic workers gave L.P. a stuffed animal to distract him, told L.P. that he was “a brave little boy,” and administered one dose of the Pfizer BioNTech COVID19 vaccine.

A clinic worker filled out a vaccine card with “L.K.’s” name, the date of administration, the vaccine lot number, and the type of vaccine dose and put the card in L.P.’s backpack. At some point, the clinic workers and school officials realized the mistake. 

The Supreme Court July 26 ruling further states that the lower court “concluded that the PREP Act provided immunity for State and school defendants involved in administering the vaccine to L.P.” The lower court allowed the Politallas to amend their complaint to a violation of the Article 11 of the Vermont Constitution, but ruled again that the PREP Act pre-empts the Vermont Constitution, that it had no jurisdiction over pre-emption, and therefore dismissed the case. 

Explaining its ruling, the Supreme Court said that “We conclude that the PREP Act immunizes every defendant in this case and this fact alone is enough to dismiss the case.” However, the state’s high court did not lay claim to ruling on the full extent of PREP Act pre-emption: “Plaintiffs’ arguments about preemption are misplaced, and therefore we need not decide today the extent of the PREP Act’s preemptive effect.”

That statement by the Vermont Supreme Court may open the door to a case before the ultimate arbiter of federal law: the U.S. Supreme Court.

  1. This is GROSS negligence-IMO!! If I had ever made such an error as a nurse my license would have been under review. Yet another questionable decision of the Vt, Supreme Court.

  3. Absolutely agree with the above commenters. This is the type of error that is completely not covered. If you kid got sick. If there was a problem with the needle, or syringe. Administering a shot to a kid who SHOULD NOT have received one cannot be covered by this type of immunity.

  4. Originally, I was thinking keep your kids in school so they know how to fight the system, but between the fluoride lobotomies, federally sanctioned changing room peeping toms, medical and psychological experiments – Take your children out of these crap holes now, or you will pay the price.

    Teachers! Leave now and start your own schools, online courses, and tutoring programs. The system has failed. Don’t feed the beast!

  6. Oh my God!! That clearly falls under medical malpractice, same as if a hospital “accidently” removed your leg instead of appendix. Unless alot of kids got mis-identified that day, I find it extremely suspicious that “LP” was misidentified by the school; I suspect some idealogically driven zealot in the school was not about to let some parent get in the way. I would be suing the crap out of that school, even money can never make up for the harmful effects that have befallen thousands who’ve gotten this poison. That school better brace themselves for what they surely know they deserve!! And at the least, that school worker needs to be fired!!!

Liberal legislature and governor equals a liberal court. Not only that, but they also move at a snail’s pace and throw legalese roadblocks in front of actual decisions to discourage plaintiffs to make justice in the courts very expensive. Another Vermont shame! All for the lawyers pockets and the cost of justice. Thank a liberal voter!

    Kangaroo court, most obviously But on a happier note, the school won’t DARE give that child a Tylenol without parental permission —- no matter how much pain the child might be in due to the hormone disrupters they can elect to have injected at their discretion.

    So, not to worry, parents!!! Keep filling in that little box on your ballot that denotes “democrat/progressive”, otherwise known as “stupid”, OK?

  13. This was discussed at length today on Paul and Guy’s Friday at Four. I watched it on YouTube. People called in. It was great and what I took away from it was the Vermont Supreme Court left a door open for the parents to keep going with this to federal court and eventually the U. S. Supreme Court and I hope they do that. Vermonters are fighters and don’t quit.

    • Interesting, isn’t it? Not in a good way either.

      Many people from out of state have said there are so many rules and rulings in Vermont make no sense, the only way to get them resolved are to take them out of state. Our justice system is in shambles, it takes way too long to get into a court room, that alone allows criminals and deviants all sorts of latitude.

      You’ll note that all our drug busts, major criminal busts…almost always have outside of state assistance, because if it were solely the state’s play, they’d let them run free.

  15. It’s time for everyone protesting to put their money where their mouth is. PULL YOUR KIDS OUT OF SCHOOL! I wonder how low enrollment would have to drop before the NEA concedes that they need to downsize? It can be done folks, we raised 4 kids from elementary through high school on a single income. My wife is a super hero, I brought home the $$$ and she did the hard work with me supplementing. How valuable are your kids? Would you rather educate them or leave them in the hands of strangers with dubious (at best) motives?

    • We can start small and do it ourselves. Take a small town, use a building, perhaps a church that is vacant during the week, plug in some online classes and fund the education. The results would be amazing. My review, we can do it for $4,000 per student per year, and get amazing results.

      Take those who voted for Trump and ask them to donate $5/year to the cause

      Now you’ve got seed money, education in one town started, you have wounded the creature otherwise known as Government School System.

      Do these 8 more times in the state and Government Indoctrination System will be dead, dead by its own doing.

      Just think a donation every year of $45 for 5 years could completely transform our education system, forever.

      That would be the best return on investment every witnessed in our little state of Vermont, frugality, love, peace and harmony would win the day.

      And if every student took advantage of tuitioning, education property taxes would decrease at least 40%, instead of increasing 14%.

    • Inherently your idea makes perfect sense. Any reasonable person would agree with what you are suggesting. The problem lies, with, they know their system is completely inept and cannot compete on the free market. So, they can’t allow that.

      Jay, the problem is they won’t’ allow it, they control the system. If they don’t get the results they want, they change the rules, yet again. Or even worse, they control the education because it’s “their” money. We would be labeled as the ones who dismantled the system, which is how they “keep” their power anyway.

      They say and people believe rightfully so, if our funding goes to outside sources then they current system will collapse (because they can’t possibly change or be more effective) they have propagandized so many in saying if we CUT ANY money to Montpelier then we won’t have money for the poor, for the children. And there is some truth to that, unfortunately it’s not called out, yes, they will cut the funding for them, because there is no way they are cutting government spending. They control the people by fear, very common.

      People are so strapped in Vermont; have been for decades, they can’t get themselves out of the system. Homeschooling is a wonderful option, but due to our indoctrination system within Vermont and the Vermont economic games being played to support government and against the people we are in a tough position.

      Your idea and plan make perfect sense, which is why they will NEVER allow it.

    • Jay and Neil, another issue is the teachers colleges. These entities are completely captured by woke, Marxist, neo-communist (collectivist) ideology. Someone was telling me recently that at UVM the first year of the teacher educational curriculum is about how to manage parents. The root of this issue is the educational programs themselves and curriculum taught to teachers.

      There’s always another issue. But we shouldn’t dilute our focus (or delude ourselves). Teacher’s colleges, most colleges in fact, are woke. But at least we have the choice of whether or not to attend them.

      The insidiousness of the public education monopoly in Vermont is that we are forced to send our children to its schools unless we are wealthy enough to BOTH pay for the public schools (thru property taxes) AND pay the costs to homeschool or send our kids to alternative schools.

      And what makes Vermont’s governance unconstitutional (by State and Federal standards) is that some families, by virtue of living in ‘qualified’ school districts, do have the advantage of Vermont’s School Choice voucher. While other families, living in non-qualifying zip codes, don’t have that advantage.

      H.405 proposes to remedy this unconstitutional discrimination. And our legislators and their supporting special interest groups (which sometimes include our courts) are breaking the law. Period.

      What do we do then, in a lawless society? That’s the $40,000 question – per student.

  16. This is exactly why each parent of a school age child is due the amount budgeted per child in public school to educate their children and protect them from systematic failure of schools. It’s a fight worth having. Only, I think we have some bigger waves ahead before we get to it. Put some extra cans aside, The whole dollar system is coming down! The deviation from the Constitution is so thick here in Vermont, its would take an axe and 5 years to cut a chink in the corruption and see light on the other side.

    • Hi Emily, you speak so many truths here. We shouldn’t fight or axe our way, that’s on their playground, where they want us to play. No, we should not stoop to their games, it’s like wrestling with a pig, you’ll get all dirty, frustrated, fail and the pig will have had a great time.

      No, let them hang by their own doings. They cannot change and that is their weakness. They are filled with pride and don’t even see they are doing wrong or harm, they are about power and money.

      This whole system could be dismantled in a year, most certainly 5 and we’d all be better for it. Through generosity, love, kindness and working in harmony with our neighbors.

      It would cost little money, would be fun and a wonderful experience for our children. It would expose them.

    I find it interesting the Secretary of Health and Human Services (no matter who is sitting behind the Resolute Desk) has the power to amend this Act, at will and at their whim. No Congressional oversight or approval necessary?

    The attorney representing the family has plenty of case law (here and abroad) to reference in regard to the bio-weapon (as classified and studied inside and out.) However, the State, the Feds, and the corporate Nephilim all ready enacted protectionism lawfare warfare – collusion and conspiracy to commit criminal fraud – (death and disabilities resulting) – boxes checked and judicial remedies locked up. Take the settlements and shut up – that is what they do and they legislated it to be so.

    Consider these other high profile court cases this week and ask yourself if our judiciary and our government (Federal or State) is not corrupt to the core? They do not represent the People – they represent and protect the corporate Nephilim and foreign interests (enemies and allies alike.)

Austin also removed the head of the U.S. military commissions – who on Wednesday had approved the settlement agreements – from the 9/11 case, which has been mired in legal quagmire for two decades and is widely considered unlikely ever to go to trial. Austin’s surprise announcement, made Friday night, cancels plea bargains that would have allowed the three men to avoid a death-penalty trial by pleading guilty to conspiracy and murder charges in return for sentences of up to life in prison.”

    US News July 31, 2024: “Families for some of the 346 people killed in two fatal Boeing 737 MAX crashes said on Wednesday a U.S. judge should reject the planemaker’s proposed plea deal with the Justice Department and the government should seek a much higher fine. The DOJ told Boeing earlier this month it could accept a settlement that branded the planemaker a felon or fight the charge in court. The Justice Department said in May that Boeing had breached its obligations in the agreement that shielded the planemaker from criminal prosecution stemming from misrepresentations about a key software feature tied to fatal 737 MAX crashes in 2018 and 2019 in Indonesia and Ethiopia. The Justice Department has a separate criminal probe ongoing into the Alaska Airlines jet that was missing four key bolts. As part of the guilty plea deal, Boeing agreed to pay the maximum fine of $487.2 million and the DOJ recommended the court credit its previous 2021 payment of $243.6 million against that, which was required by 2021 deal.”

I’ve never understood and questioned each time I was confronted with librarians in particular shame/guilting me into wearing a mask (science does not support masks as an effective block to… unproven existence of viruses – see Antoine Beauchamp vs Louis Pasteur), and insinuating by the six=foot distancing (8th grade science fair project of a politician’s daughter – no actual science proven according to Koch’s principles) that I had cooties (my immune system has had no interference by chemicals that don’t come in food, water and air now) — and offering me a genetic marker testing kit (PCR test — look it up, and Kerry Mullis who conveniently died in 2019 protesting the use of PCR tests for testing for viruses – something they were not created for by a long shot) to ‘test for the virus’ (that doesn’t exist) that clearly I don’t have as I am breathing normally, not coughing or sniffling…as a respiratory infection or illness tends to do… and not exuding any effluents… yeah… practicing medicine without a license much?
    I actually said that to a librarian… in 2020… I was not welcomed back there.

    The world right now has little to no authenticity, sincerity, let alone a handle on the truth… and that is purposeful.     Medical malpractice is in play for everyone who is NOT medically licensed (by a medical board not mandated by gov’t to bypass those standards of care) and making people mask, socially distance or isolate (except in the case of ICU cases) or take the shot (mark of the beast)… and we should start testing out whether the gov’t ever had the right to bypass medical standards for politics… cause NONE OF THIS IS REAL.

    • I’d like to suggest that perhaps evil is really pride or it’s caused by pride, meaning I know everything, couldn’t possibly be wrong. Then when you fuel people with pride, AND they get into power or have experience taking power they become narcissists, which is a quick trip to becoming a path person, sociopath, psychopath.

      As a society we can create our own problems, just like we can create dogs that are completely out of control and can’t be trusted, by abuse, etc. This is what we’ve done. As a society we have built a selfie generation, who relies upon “google” for all the answers, lol and they are geniuses. But truly they are only geniuses to their own folly, pride and whatever idol they have picked up along the way. They have become gods in their own minds.

      This is where things/society/families/people break down. This is where GOD kinda takes over……just ask Nebuchadnezzar, just ask Alexander the Great. We are not great, we are completely a hot mess without the love, wisdom, forgiveness and teachings of Jesus Christ. Vermont could not possibly be much further from Jesus Christ, so we are creating our own problems….

      When you can see this within yourself, you understand very quickly how this could happen. You also realize we need God, he doesn’t need us. If Jesus hadn’t come to save us, to forgive us, well, we’d be living like the Aztecs, the Romans (1/3 enslaved), like some backwater tribe…..

      We are teaching Vermonters they are God, and can rule the world, they are completely righteous in their political endeavors. Yet we don’t allow God’s love and wisdom in our schools, so here we are, a hot mess, aka Vermont.

  26. This case is a natural progression from all the childhood vaccine mandates for attending school. The progression includes an ever increasing number of vaccines and the removal of Vermont’s philosophical exemption which was fought by citizens but lost to Big Pharma’s lobbying the legislature. None of the vaccines on the CDC schedule are either safe or effective and many have been injured and suffer life long consequences.

    • When the FDA employs former executives of pharmacutical companies, when patents are filed well in advance of a “pandemic,” when children can’t attend school without a plethora of vaccinations (how many now? I lost count. I hear they start at birth now,) when informed consent is no longer practiced – what could go wrong? We saw it with the swine flu in the 1970’s. AIDS in the 1980’s. Vioxx in the 1990’s. Never forget and never let them, any of them, off the hook.

  28. This absolutely boils my blood! Who do you think you are giving anyone shots without their parents permission. Last thing I knew we the people have authority over our children not the government not school not anybody else. I stand on the word of God (not because I’m religious, not because I’m a quack, but because I am a red blooded woman loving her family.) With all of the hypocrisy that has been going on for the last how many ever years. I don’t trust anyone touching my kids.

    I pray for my family almost daily and I ask for God to put protection around my kids and their kids. This is just out of hand. If people only would look to God for their peace ( I know we still have to live in this world, but we don’t need to be worldly, we can actually have a strong holy ghost life along with our physical daily life. He is waiting and wants to be part of our lives every day in every way. Often I am reminded that without him I would not be here or my parents or their parents etc.

    Also, I am not stupid enough to let others tell me I’m living a pipe dream, because I have seen God work in my life. I have seen him change me from a scared little girl to a grandmother with an agenda that includes my father in heaven because he will never leave me nor forsake me. I’m just tired of hearing what will we do? Instead of loosing your mind in worry, stop and ask him for peace, the peace that passes all understanding. No, this is not always easy when we are scared, but I can assure that he is control. Ask him……. It is a renewal process, it isn’t a one time thing, we have to remember that if we ask him to save us that is the one time thing, but we will have things come against us every day. Are we going to believe or walk away when things get hard. We need to lean into him not away from him. God gave us our children and if you read in proverbs it tells you 31 days of things to teach your children….Your children not anyone elses. Rest assured God loves your babies more than you could ever imagine. He knows what is happenening. Talk to him….have that relationship with him. Don’t have the religion with him. He can be pretty funny at times in the ways he responds.

  29. Sadly, parental rights are continuing to circle the drain. I sincerely hope this case ends up with the US Supreme Court. They need to settle this issue once and for all, in accordance with the US Constitution.

  31. I recall when I 1st heard of this, it was shocking because it was said DMED keeps the most accurate health statistics of any healthcare data in the world (because it is our Military … the Defense Dept of the United States).
    I copied the link above with the stats from a post on “X” today … but know this data started showing up years ago to everyone’s alarm.

    I have no doubt they are real Guy, but am just hoping I can access the actual Data Base if it has not been scrubbed. I know of people I can contact to help. I’ve heard the VAER’s Data Base was tampered with (they scrubbed thousands of C19 injury reports).

    I have a ‘Chrome Book’ (Bill Gates Microsoft Lap Top) after my MacBook crashed and it blocks me from accessing search engine called Yandex.com. I encourage you to try (I’m unable to). Yandex.com is great for fact-finding; perhaps DMED’s Health Data. Even search engine DuckDuckGo.com has been taken over.
