The selectboard of the Bennington County Town of Stamford voted Dec. 17 to affirm the constitutions of Vermont and the United States, in response to the governor’s restrictions on gathering for worship, work and socializing.
The vote follows the Dec. 3 decision by the Stamford selectboard to defy Gov. Phil Scott’s Covid-19 emergency orders by not canceling a Dec. 4 public gathering: the traditional family-friendly lighting of the town Christmas tree. The Dec. 3 meeting featured an exchange between selectboard member Dan Potvin and Rep. Laura Sibilia.
Potvin: “Laura, you took an oath to uphold the Constitution, I would imagine, and you guys are running over it along with the governor.”
Sibilia: “Absolutely not, sir….If you believe that is the case, you need to go to the courts.”
Potvin: “I’m telling you! I’m telling you to tell your comrades when you’re up there that we’re not going to put up with it down here.”
After the tree lighting, some observers what if anything would happen next. They got their answer when, according to unapproved minutes of the Dec. 17 meeting, Town resident Brandon Field presented the Selectboard, meeting in person at the Town Office, with a petition signed by many townspeople asking the board to support and uphold the constitution of the state and federal government.
Selectboard member Mike Denault affirmed that the selectboard members each took an oath to uphold the constitution when they were elected. Visitors questioned why this was being brought forward. They said the selectboard does uphold the constitution.
Town resident John Paul Potvin (son of selectman Dan Potvin) said he is worried about our government stepping on people’s rights and does not want any of our rights taken away. Resident Eleanor Derby Kilfoyle stated that the Gov. Phil Scott’s orders are only recommendations and that he is trying to protect and keep people safe. John Paul Potvin said the orders are hurting a lot of people and their livelihoods. Dan Potvin said the governor’s order to limit holiday gatherings is an infringement of our rights.

RELATED STORY: Gov. Scott today (Dec. 22) announced he will continue the restrictions on holiday gatherings, with two relaxations:
- Between Dec. 23 through January 2, households will be allowed to gather with “one other trusted household.”
- Outside gatherings will be permitted provided social distancing and masking is allowed.
The interstate travel policy is unchanged, Scott said. “I know this has been hard. But it’s made a difference,” Scott said of the holiday gathering limitations.

At the Dec. 17 Stamford meeting, it was mentioned that of 37,000 people in Bennington County there has been one death. (Today’s Bennington County data on USAfacts.org show two deaths, and 379 cases.)
Denault said he knows people who have died because of the virus. But he also knows people who have died of the flu, cancer, suicides, drug overdoses, and car accidents, and he feels sorry for all families who have lost someone, but it doesn’t override the rights of all people under the constitution. He said he whole-heartedly supports the petition.
Eleanor Derby-Kilfoye suggested this should be brought before the voters at town meeting.
Dan Potvin disagreed. Denault said this petition is not meant to be a reflection of the townspeople’s views. He said the purpose of this petition is a request that the Selectboard, who took an oath to uphold the constitution when they were elected, re-affirm that oath that they will continue to support the federal and state constitutions.
Resident Pat Sullivan said people in town do support the constitution. Selectboard member Chris Warren said this proposal is projecting viewpoints that not every person holds. John Paul Potvin said this petition is not a reflection of the Selectboard; he is looking at the big picture and of our country, and wants to make a statement and safeguard our rights.
Selectboard member Nancy Bushika and Denault commended the young people for coming tonight, standing up for what they believe in, and hope they will stay involved.
Denault moved the Selectboard adopt and affirm that ‘we will uphold the Constitution of the United States of America and the Constitution of the State of Vermont.’ The motion was seconded by Dan Potvin and passed by a 4-1 vote, with Warren opposed.
Dan Potvin would like to send the signed petitions to the governor, the state legislators, the federal government and the Bishop of Vermont. Visitor Kevin Hoyt suggested it be sent to the other towns in Bennington County. Denault agreed with sending it to other government entities, but not to the bishop. The board agreed and voted 4-1 to send it to the Governor, the state legislators, the federal government, and the other towns in Bennington County.
The approved petition reads as follows:
We the People declare this town of Stamford to be a Constitutional Town of the United States of America and of the State of Vermont. We hereby ratify the Original Intent of both our state and federal constitutions, which serve to protect and preserve our God given rights. Neither the legislature nor any executive or judicial officer may disregard the provisions of our Constitution which our founding fathers fought to establish and generations of veterans shed blood to preserve. No kind of emergency, perceived threat, or suspect danger is reason to usurp our rights and liberties as citizens of this great nation. We hold these dear above all else, echoing the words of Thomas Jefferson, “When you abandon freedom to achieve security you lose both and deserve neither.” We choose to stand firm on God and our Constitution, in the face of any tyranny that may seek to rob us of our freedoms.

They alone, if well informed, are capable of preventing the corruption of power, and of restoring the nation to its rightful course if it should go astray. My hat is off to the residents of Stamford! The US Constitution is still in effect, and if Biden or Harris take the oath, they are still bound by the Constitution, also. What’s Governor Phil’s deal? The edicts he’s giving make it sound like they’re not ‘helpful suggestions’, but ‘The Law Of The Land’ here in Vermont. If he’s telling us what we ought to do, but without the authority to enforce it, well then, “Fine! Thanks for the suggestion, Governor.” Leading up to Thanksgiving, it ‘sounded’ like the police would be on the look out for homes with enough cars to suggest there was more than one family in the gathering, THEN they would stop and investigate. There were also the news articles that said teachers were supposed to quiz kids on how they spent their holidays, and if kids said they had families other than their own or Heaven forbid, out of staters, there would be consequences! Didn’t the Supreme Court already rule that these heavy handed edicts are unconstitutional? SMH…
How ironic – there is a picture on the web version of this article of veterans, in our veterans homes, holding up signs saying “Hello there from the Vermont Veterans home”, and “Hi there just wanted to say hello”. These poor people must be lonely and tired and scared. How many outbreaks have we had in Vermont in congregate living situations? And surely, the only way covid gets into these places is by those from the outside bringing it in. The more prevalent it is on the outside, the greater the chance it will make its way inside, and no doubt cause unnecessary deaths. We’ve seen it over and over. So those in Stamford who do not agree with the precautions that our governor has put in place, I beg you to go to those Veterans homes – there’s one right in Bennington, and tell those brave Americans, who fought for the freedoms you enjoy, why you can not wear a mask to help protect them. Why you can not make simple sacrifices to help protect us all. Your freedom is not being taken away, theirs is.

Thank you, Lee. I forgot how I found out about Stamford – I think actually it was Vermont Public Radio (!) doing a story on the Dec. 3 meeting. Anyway, I connected with Dan Potvin and the rest you know.
