Randolph volleyball player, dad sue school for unfair retaliation

A Vermont school district punished both 14-year-old Blake Allen and her father for stating that a biologically male student who identifies as a transgender girl is male. Now the Allens are suing the school district—and accusing it of retaliating against their family for speaking out.

Represented by the Alliance Defending Freedom, Travis and Jessica Allen alleged in a lawsuit filed Thursday in the United States District Court for the District of Vermont that Travis and Blake “were punished for expressing their view on a matter of profound public concern: whether a teenage male who identifies as female should be permitted to change in a girls’ locker room regardless of the discomfort experienced by the girls in that room.”

“In objecting to a male being in the room while the girls are changing, Travis and Blake each made comments underscoring that the trans-identifying student is in fact a male, including by using male pronouns,” said the lawsuit, which was first obtained by The Daily Signal. “Indeed, their view of the student’s maleness was foundational to their opinions on appropriate use of the locker room.”

“Yet, their remarks were too much for Defendants’ transgender orthodoxy—Travis was deemed to have ‘misgendered’ the student, while Blake was found guilty of ‘harassment’ and ‘bullying’—so Defendants disciplined both of them.”

Superintendent Layne Millington, co-principals Lisa Floyd and Caty Sutton, and the Orange Southwest School District Board are state actors and “violate the First Amendment” by attempting to dictate “what may be said on matters of public concern,” the lawsuit said, noting that these school district officials also cannot discriminate against speech on the basis of its viewpoint.

“Yet, that is exactly what happened here,” the filing states. “Defendants punished Travis and Blake for saying that a male is a male, as a matter of sex and biology, regardless of the gender identity that the male has assumed.”

The Daily Signal first reported that Travis Allen has been suspended without pay from his job as the Randolph Union Middle School girls soccer coach for calling the trans-identifying student a male. His suspension followed a Daily Signal video and report highlighting Blake’s discomfort at a biological male using her locker room while she was changing. Jessica Allen also spoke out in the video.

Several of Blake’s fellow female students who spoke with The Daily Signal shared they asked the student to leave, but said the student did not immediately do so. The girls said that the student stood in the corner and looked at them while they were changing, causing them to feel uncomfortable.

The trans-identifying student’s guardian told The Daily Signal that her child is a girl, belongs in girls’ spaces, and did not behave inappropriately.

“A male was in our locker room when volleyball girls were trying to get changed,” Blake said in the mid-October interview. “And after I asked him to leave, he didn’t, and later looked over at girls with their shirts off. And it made many people uncomfortable and feel violated. And I left as soon as I could in a panic.”

“It’s not fully the trans student’s fault,” she added. “It is much more the school board’s fault and they’re failing everyone. Not just the volleyball team, not the transgender student. They did nothing to help this situation. They still aren’t. They just want people to be in trouble and they’re not trying to help make a change.”

  1. The world is so upside-down! What is right is wrong and wrong is right. In a sane, truthful world, what is taking place at Randolph Union High School, should not be happening. Sometimes I just shake my head and wonder how people can really be believing what they are arguing and doing. It is so basic that God created two sexes, male and female and did that for good reason.

    Who would ever believe our civilization would allow foolish school administrations whose job it is to protect students and to teach real facts, to do just the opposite by condoning such immoral actions and punishing a female student and her father for declaring their objections to it all.

    How can responsible adult leaders permit a biological male in a girl’s locker room to view them changing and then punish the girl and her father for pushing back about such evil. Schools have become playgrounds for progressive liberals to ply their anti-family, anti-Christian ideas on us all.

    Thankfully, there are people brave enough to stand for the truth. This is America, once an undeniable stronghold of freedom and we must wake up for we are being controlled by leftists who are preaching and forcing lies on us all.

  5. It is high time that genuine Americans who respect & honor the Constitution & its amendments drag these Marxist-type dictators into courts of law.

  6. The Randolph school administration says the Vermont law that deals with “public accommodations” gives the school no choice but to obey the law. (Title 9, Commerce and Trade, Chapter 132). As written, Vermont accommodations laws “are intended to implement and to be construed so as to be consistent with the Americans with Disabilities Act, 42 U.S.C. § 12101 et seq. and regulations promulgated under that act and are not intended to impose additional or higher standards, duties, or requirements than that act.”
    Importantly, the Federal law referenced by the Vermont statute does not include “gender identity” in the definition of protected individual characteristics. Protections against discrimination are given “on the basis of race, color, religion, or national origin.” Also, the Federal law referenced by the Vermont statute excludes public schools in its definition of “public accommodations” but specifically lists private schools as well as many places of commerce. A reason for this could be that public schools are creations of the state, while private schools are commercial enterprises that fall under federal interstate commerce laws.
    Regardless, the “intent” of Vermont’s law to be consistent with Federal law is undermined by its own language. Is this because when first adopted Vermont’s law did adhere to Federal definitions but over time the law morphed into the problematic, self-contradictory mess that Randolph school administrators feel compelled, and are apparently more than willing, to adhere to? Blame the Progressives in the legislature and for this and vote them out!

    • If a bureaucrat (Millington) is forced to violate citizen’s First Amendment rights in order to uphold a state law, then that law is unconstitutional and must be ignored.

  7. Why can’t these people understand that a dude pretending to be a chick isn’t actually a chick? And that folks like myself will generally play pretend along with them… up to a point. Perving on my daughter is WAY past that point, and claiming that this amounts to “hate,” is gaslighting behavior that merits at the least, public shaming. They don’t get unaccountable pretend license, and nobody should ever be forced to play along with something that usually amounts to mental illness, especially when used as an excuse for perverted behavior toward others.

Since most public officials and the leftist media of Vermont, in brazen acts of virtue signaling and wanting to have their Rosa Parks moment in the sun have framed the girls as the intolerant bigots and the locker room interloper/voyeur as the victim. Not sure if the girls and their caring parents will find any remedy in a Vermont courtroom or with the Human Rights Commission since the deck is also stacked to the left in those venues. The bottom line is, our civilized society has always been comfortable with gender-segregated changing facilities, public restrooms, certain sports and the prison system. That segregation has ALWAYS been based on ANATOMY, and for good reason. There is no logic in changing that. It was set up primarily for the protection of females and Title IX of the Federal Civil Rights Code was set up through the efforts of many persistent activists to uphold that convention. If someone wants to express and identify as something other than that which they were born with, that is fine but dont mess with the infrastructure conventions. THEY ARE APPROPRIATELY BASED ON ANATOMY, NOT FEEWINGS.

    • Exactly!!! Very well stated. I know an adult that has had a sex change, and is (now) indeed a woman, and happily. That is much different.

    I’d like to pint out that I recommended lawsuits as a way to resist the tide since I’ve been Commenting here. Non- violent forcefulness.

    • It is understandable that many on the left have a negligible knowledge of economics, but someone needs to inform them that if we keep firing people for not getting jabbed with the ineffective vaccine or for having the “wrong” opinions, that there will be no one left to actually do anything useful.

    The best thing we did was remove our children from these govt schools.
    So proud of this young lady and her dad for refusing to back down. We need more dads to join in.

  13. And just as with the Tiffany Riley BLM free speech case, Vermont taxpayers will be left footing the bill for the likely 6- (or 7-) figure ensuing settlement(s).

    Sadly, it will take *many such lawsuits* before people wake up and realize that whom we vote for has a direct impact on our bank accounts (not to mention the health and safety of our children.)

  14. As a person well into my adult years, I would feel uncomfortable changing in a locker room in front of a woman pretending to be a man. I find it refreshing to travel over to America in New Hampshire observing the male and female or men and women signs on restroom doors. Never in my wildest dreams would I have envisioned that Vermont would turn into the Twilight Zone with one nightmare after another hitting us adults on the head. It is the voters fault that we as a state have sunk into an abyss of insanity by invasive, out of state legislators who moved here to imprison Vermonters in an alternate reality created for their cult like adherence to all things unnatural and against the norm. Vote wisely people because the shock value meter moves closer to chaos every day that progressives are in power.

  15. As a former member of a school board, they’ll start out hardline then when their attorney lets them know the percent chance the decision will be in your favor they’ll want to settle, providing you keep the settlement confidential. $$

    • Can it really be kept confidential though? Since public funds will be used to pay it, it is of utmost interest to the taxpayer, and presumably subject to disclosure via public records request.

    • If the school officials lose this case, as they surely will, the settlement should include the termination of their employment. The taxpayers must not be required to subsidize people so committed to authoritarian stupidity.

  17. I like when people promoted past their level of competence expose themselves. The Peter Principle in graphic action. They are unnecessarily costing taxpayers a lot of money, angst, and embarrassment. Will they be allowed to continue to do so?

  18. You think that this lawsuit as a result of the actions of the participants is confusing, wait until they start arguing in court of the Article 22/Prop 5 issues ref “reproductive autonomy” and all of those issues surrounding it. Your head will really be spinning then.

We have been led to to affairs such as this by our own rejection of any transcendent truth or higher authority to which we as individuals and society must submit, and the adoption of the belief that we can, and have an unalienable right, to create our own reality. Such is the sanctity of the fully autonomous person that we guard their illusions of being able to determine their own gender. It is time to end this foolishness. The emperor has no clothes. I applaud this family for standing up to this attempt to coerce a change in our culture that has no basis in fact. We should all do the same.

  20. The entire world sees this news story yet WCAX and Local 22 refuse to acknowledge this. Last week Kari Lake totally eviscerated the msm in Phoenix. The msm is the propaganda tool of the progressive dem party. Lie and misinform the public is their mission and Kari Lake exposed them all for not being real journalists. Soon there will be no reason to honor freedom of the press if they continue to function as an active part of a political movement.

  21. Let’s be clear, this “boy” was not changing in the girls locker room, but was pervetly watching the girls change. The have every right asking him to leave.
