NEWPORT — A U.S. Customs and Border Protection agent, who pleaded not guilty in Vermont Superior Court in Newport last month to two felony charges of sexual assault on a girl under age 16, is now facing more unrelated criminal charges.

During the course of an unrelated investigation, it was revealed Malik Daley, 39, of Barton, had inappropriate conduct with an adult female sometime between the months of March and April 2026 at a residence on Glover Road in Barton, state police said. 

Daley was subsequently issued a citation through his defense attorney last week for the offense of lewd and lascivious conduct, Detective Sgt. Joshua Mikkola said.

Daley is due in Vermont Superior Court on July 28, he said.

It was unclear Daily’s status with CBP after his first arrest.

During the earlier incident, Orleans County State’s Attorney Farzana Leyva charged Daley with committing sexual acts with the girl on May 11 and on May 17/18 at Barton.

Vermont State Police said detectives arrested Daley at Derby Line after a short investigation and brought him to criminal court for an immediate arraignment.

The girl had been reported to Trooper Jacob Shores as a runaway by her family, but there was no luck finding her overnight, police said.

Mikkola said criminal investigators joined the case the next day and more leads were developed.  Mikkola and Detective Sgt. David Robillard eventually found the teen walking in Barton, but she gave a false name and had changed her appearance, police said.  They confirmed her real identity.

Detectives later learned that Daley had befriended the teen and eventually interviewed him, Mikkola said.
