    I am very sympathetic to addiction, but also to accountability. I’m curious why a legislator gets a public defender — that is customarily reserved for people who lack finacial resources. Why are taxpayers paying for both the prosecution and defense? Do Vermont citizens get a public defender at his income level, or did he qualify as low-income? And why on earth would the judge bend over backwards to invite a probable cause challenge? Even a child can see this officer had oodles of probable cause…..

    • John, while I am not a lawyer, I am wondering if the probable cause in question has to do with the the DUI charge itself given the BAC levels recorded on the filed device as opposed to the DataMaster(?) device at the station. As for the public defender, I wonder if he was temporarily appointed for the initial arraignment since Carroll
      was at an in-patient treatment center at the time?

      My prediction is that Carroll will hire a private attorney to challenge the BAC readings and either get the case dropped or the charge reduced and a plea agreement. Even the senior forensic chemist stated that Carroll’s actual BAC at the time could have been as low as .076.

      John, as you questioned, I imagine the judge will be more apt rule in favor of a State Rep. Either way, the court of public opinion has already made judgement.

  3. Bill in NEK, as to the possible .076 BAC, one can still get a DUI without meeting the minimum BAC…last I knew anyway.

    • Yes. All the pharmacies I called said they were forbidden by government order, even though I had a prescription. The order to which they referred was (I think) a Vermont Department of Health order, but certain memory escapes me on that detail. The Great War Against Ivermectin, whose developer won a Nobel Prize for HUMAN use as an anti-parasitic, was one of the most deplorable government initiatives of the Covid-19 era. I believe it was motivated by their zeal for universal Covid-19 vaccination. No competition could be tolerated.

    • How is that not manslaughter? Keeping a prescribed potentially lifesaving medicine from from a person?
