Vermont risks lost federal funds, prosecution over immigration pushback

A group of state attorney generals including Vermont’s Attorney General Charity Clark have signed a statement doubling down on resisting Trump administration enforcement of immigration laws.

According to one executive order from the Trump administration on Jan. 20, such a move could potentially put both federal funds at risk and open the state up to federal prosecution.

The AGs wrote, “It is well-established—through longstanding Supreme Court precedent—that the U.S. Constitution prevents the federal government from commandeering states to enforce federal laws,” according to a joint statement published by the Vermont Attorney General’s Office.

The statement continues, “While the federal government may use its own resources for federal immigration enforcement, the court ruled in Printz v. United States that the federal government cannot ‘impress into its service—and at no cost to itself—the police officers of the 50 States.’ This balance of power between the federal government and state governments is a touchstone of our American system of federalism.”

Showdown looming?

Bloomberg News reports that sanctuary cities across the nation are preparing for conflict with the incoming administration.

“Cities across the US are making preparations to protect immigrants from Donald Trump’s planned mass deportation program during his second presidency,” Bloomberg states. “Los Angeles passed an ordinance in November that prohibits municipal resources from being used for federal immigration enforcement.”

The Center for Immigration Studies as of this month lists 13 states, including Vermont, and 200-plus cities and counties as having policies that limit compliance with federal immigration.

Federal funding in question?

On Jan 20 the Trump administration issued an executive order clarifying that they will enforce federal immigration laws.

“Enforcing our Nation’s immigration laws is critically important to the national security and public safety of the United States,” it states. “The American people deserve a Federal Government that puts their interests first and a Government that understands its sacred obligation to prioritize the safety, security, and financial and economic well-being of Americans.”

It clarifies federal money may be withheld from states that refuse to enforce federal laws.

“The Attorney General and the Secretary of Homeland Security shall, to the maximum extent possible under law, evaluate and undertake any lawful actions to ensure that so-called ‘sanctuary’ jurisdictions, which seek to interfere with the lawful exercise of Federal law enforcement operations, do not receive access to Federal funds,” it states.

Another section deals with public benefits for illegal aliens in the US.

“The Director of the Office of Management and Budget shall take all appropriate action to ensure that all agencies identify and stop the provision of any public benefits to any illegal alien not authorized to receive them under the provisions of the INA or other relevant statutory provisions,” it states.

Potential prosecution?

In addition to risking access to federal funds, the State of Vermont could potentially find itself in the legal crosshairs of the new administration.

The executive order states, “Further, the Attorney General and the Secretary of Homeland Security shall evaluate and undertake any other lawful actions, criminal or civil, that they deem warranted based on any such jurisdiction’s practices that interfere with the enforcement of Federal law.”

The Bloomberg story further states, “A top Trump administration official told Justice Department staff that the DOJ will investigate and may prosecute instances of state and local authorities ‘restricting, obstructing and otherwise failing’ to comply with immigration-related orders and requests from the administration.”

    • Considering over 70% of the “people” voted for these removals, I can see also a quick removal of those who continue to go against “us” who voted to put Trump in office and clean up the U.S. Those who only dream at this point of interfering in the process would be wise to either step down from office or find another job.
      A rude awakening is on the horizon!

  1. Charity Clark should consider what she would look like in an orange jumpsuit. I’m no fashion expert, but I dont think it would do much for her.

    • She’d be in green or khaki (Camp or Low security, respectively), and not a jumpsuit. At least the Feds would give her a REAL job…for 12 cents per hour.

  4. The federal government can bring in its own resources and bypass State resources. Problem solved! How can the state make taxpayers pay to provide services to illegal migrants? You can’t force Vermont citizens to financially support breaking federal law.

  5. So those elected officials who stand in the way of the Federal government’s authority to remove ” Illegal Aliens “, as they are criminals that broke our laws, and any elected official including Attorney Generals, Governors, and Mayors are not above the law !!

  13. Well-sometimes-“what goes around comes around”. Some of us were not even aware that Vt. is a Sanctuary State, and folks that follow what is going on, or at least try to. When was that decision made, and by whom? Just curious.

  14. Wasting more funds on an unwinnable lawsuit…. sheesh, surprise. The Feds are attempting to remove illegal aliens. They’re stealing from “We the People”. I realize this comes as a shock to some people. Namely those who are making money from having them around. Vermont can’t balance a budget on its own as it stands. They’re going to be in a real pickle when they cease. Once again, to be a fly on the wall……

  15. The absurdity of Dem politics is that even a state AG will oppose federal law to fight a Republican, even if following the law will do good, like arresting illegal immigrant felons. Dems will defend felons versus defending the peace of a community if it means they can score points with liberals.

Now that the Trump is President and is crushing the Progressive media industrial complex, Vermont citizens are going to need to decide.   18. The majority of the contributors to this forum need a refresher in early American history. Our Founding Fathers feared an all-powerful executive having recently removed the yoke of a monarchy. That is why they established a government with checks and balances. Governing by executive orders would have been deemed TREASON. When the Speaker of the House says he disagrees with the president, but he will go along with him because he is the president, the system is FAILING.

    • United States Constitution, Article II Section III (paraphrased)”he shall take Care that the Laws be faithfully executed, and shall Commission all the Officers of the United States.”
      Article IV Section IV- “The United States shall guarantee to every State in this Union a Republican Form of Government, and shall protect each of them against Invasion; and on Application of the Legislature, or of the Executive (when the Legislature cannot be convened) against domestic Violence.”

      18 USC §1325, “Improper Entry by Alien” Is the statute.

      There are checks and balances to the Executive Order:
      1-Congress can override executive orders by passing legislation that counters or nullifies the directive
      2-The judiciary serves as a critical check on executive power
      3-Federal courts, including the Supreme Court, have the authority to review executive orders

    • Perhaps a refresher course is more appropriate for you, constitution 101. The government consists of 3 equal branches, executive, legislative and judicial. When the legislative branch doesn’t agree with the executive branch they can call on the 3rd branch (the judicial) to settle the issue. In fact, others that may have standing can sue the administration.

      The president has the authority to make executive orders. If they aren’t challenged they stand on their own. In this case the president has invoked an emergency at the border which gives him more power to deal with the situation. Illegal drugs, human trafficking, illegal guns, gang members from other countries killing and raping of Americans and people dying of drug ODs is an emergency.

      These are dangerous times in America for Americans. These laws and actions do not stop where your misguided feelings begin. For every gang banger removed is one more life saved or one more rape no committed or one less load of illegal drugs not delivered or one more child not trafficked in the sex trade. You really should be ashamed of yourself for defending the invasion of the country under the most corrupt administration in the history of the USA. Your opinion is also week and the voters of America want these illegals out.

    • Too funny, people are so used to making weak arguments as complete truth in Vermont because it’s all an echo chamber and others are not allowed to comment. Quickly the commentators bring in other points of view that suddenly render what was once a solid indictment (of said ham sandwich) and the whole argument collapses.

      This is the power of free speech. Many on face book are claiming it’s gone extreme right wing, because for the first time they are seeing valid counter arguments and people speaking freely.

  19. If Vermont officials merely stand aside and do not interfere with ICE, they probably will not be arrested. However, if they actively interfere, block, conceal, or otherwise thwart ICE in its enforcement of immigration law, they render themselves subject to arrest pursuant to 8 USC 1324. The mayor of Chicago declared he was willing to be arrested for protecting illegals. Tom Homan said he was willing to arrest him.

  21. When the top law enforcement (I repeat, LAW ENFORCEMENT) officer in the state says, no, our priority to to protect those who broke the law, that person immediately should be removed from their position. HOW ABOUT YOU FULFILL YOUR DAMN OATH, CLOWN!!!
