Mother who left him in car was medical doctor
A medical doctor, whose 17-month-old son died after being left for a day in the backseat of her car in Milton on July 24, will not be facing any criminal charges, according to the Chittenden Unit for Special Investigations.
Authorities identified the dead toddler Friday afternoon as Ezra Bode of St. Albans City, CUSI said.
The preliminary findings are Bode died from hyperthermia (overheating) due to environmental exposure, according to Burlington Detective Lt. Richard Weinisch, the director of CUSI.
Weinisch said the final cause and manner of death for Bode are still pending additional laboratory testing by the Office of Vermont’s Chief Medical Examiner.
Bode’s mother was not identified by name, but is a doctor at the UVM Family Medical Office at 28 Centre Drive on Milton, officials said.
His mother “forgot to drop him off at daycare on her way to work and he was subsequently left inside of a parked vehicle during her workday,” Weinisch said in the news release.
The ABC Daycare Academy is on U.S. 7 in Milton, not far from the medical office.
The UVM Medical Center officials have not told patients or issued a public statement on whether they have removed the doctor from her medical post while the death investigation continues.
The medical office has a large parking area for the public in front and to the left of the building with patients frequently in and out. Staff parking is in a small, designated area off the right side of the building with limited foot traffic.
The toddler, who was found in his car seat in the vehicle a few minutes after 5 p.m. July 24, was unresponsive and non-breathing, CUSI and Milton Police have said. Milton Rescue, which is located at the municipal complex just down the street on Bombardier Road, was summoned.
With Milton and South Burlington Police clearing the roadway for the 15-mile trip, Milton Rescue personnel provided lifesaving efforts on Bode as he was rushed to the UVM Medical Center in Burlington, officials said. Lifesaving efforts stopped upon arrival at the hospital, Milton Police had reported.
The office of Chittenden County State’s Attorney Sarah George has indicated she believes there is no probable cause under the law to file any criminal charge, CUSI said in the news release.
The news release did not say whether convening a county grand jury for an independent review for the unusual death case had been considered, or if CUSI sought a second legal opinion from the criminal division of the Vermont Attorney General’s Office. The Vermont AG’s office has successfully prosecuted 3 homicide cases that George refused to tackle.
CUSI consulted with the Vermont Department for Children and Families (DCF), Weinisch said.
Weather records show temperatures in the Burlington area were in the low 80s for much of the work day on July 24.
Child deaths are tough on first responders, medical personnel and the general public, Weinisch noted in his news release.
“In addition to the unimaginable grief and trauma this family has suffered, I would like to caution the media on the effects of secondary trauma, noting that this story may be difficult for readers/viewers to hear. This investigation has taken an emotional toll on the first responders, the investigators, DCF, and everyone else that has been involved,” he wrote.
Police and medical personnel across the state since the death have said they were unable to recall a similar tragic case in Vermont history.
The unusual nature of the case had generated considerable community discussion, including why police opted to withhold standard public information for more than two weeks. There also are numerous concerns or questions whether the mother/doctor is getting special treatment because of her medical position.
Milton Police, the initial responding police agency, reported CUSI had directed them not to provide the community with any details after an initial brief news release.
Law enforcement, medical personnel and even animal groups have issued frequent safety reminders about not leaving children, the elderly or animals inside cars, especially on warm days.
Weinisch said the National Highway Traffic Safety Administration has done extensive research on this issue and is currently working with vehicle manufacturers to standardize vehicle reminder alerts to check the back seat. CUSI also reported on Friday the child was 17 months old. Milton Police in the initial news release had said 18 months old.
CUSI is an intermunicipal police unit established to handle special investigations, including sex crimes and child abuse cases in Chittenden County. It was started with a focus on protecting children and public education. Larger communities assign detectives to CUSI, while smaller towns in the county provide tax dollars for annual expenses.

There is much more to this story than “Authorities” are releasing IMO. How in the hell does one forget about your 17-month-old child sitting in a car seat in the back of your vehicle?? UFR!
There but for the Grace of God go I. This could so happen to me. I turn into a robot when driving to work. Especially if there is any change in the schedule. Every time I hear of one of these very sad stories I think of how easily it could have been my story.
God help this woman get through her grief. Ladies – put you purse beside the car seat. Or take your shoe off and put it in the backseat.
Also, the torture the mother will go through for years on end imagining what her poor baby went through is pure punishment as well – she needs prayer, not condemnation.

I’m so incredibly sorry to learn of this and can only begin to imagine the horrific grief this mother must be enduring now and sadly always will to some extent.
My only hope is that this poor woman has both an extended family as well as a faith community that will emphatically embrace her & that she will entrust her own care now to God to help her understand beyond any doubt that her baby is back with His Creator and that parents & little one will be reunited again one day of God’s choosing.
These tragedies sadly occur with frequency during the summer and can very obviously be sometimes directly attributed to the stressors of our era in raising a family coupled with work-related duties, as in this particular instance, in being a medical professional & the resultant exhaustion from both long hours & the massive responsibilities medical doctors negotiate on a daily basis.
Judging this woman whose life is forever altered in light of a grievous error she unintentionally made while being harried & hurried due to the intrinsic demands of her altruistic profession is cruel and unjustified in light of the preliminary conclusion that no criminal charges are to be filed.
Instead of condemnation, prayers for this family would be more befitting as most hope that the peace that passeth all understanding will be bestowed through God’s grace & that this family can one day, somehow be able to live the remainder of their days knowing that reunions await and that both God & child possess great forgiveness. I’m certain that baby boy, though merely 17 months of age, understood how much he was loved and will remain so loved forever.

Kathleen, I’m sorry I’m not a bleeding heart type of person, how can you forget the most precious thing in your life, the person you brought into this world?? What could be so, or more important to you!!! Did she put her work and patients above her child. How do you go through the whole day and not even think of your child and if their day is going well or not ??? Kathleen, all you spoke of was what the mother was going to have go through and bear, what about the horror pain and agony the child had to bear while it was literally roasted like a chicken on a rotisserie for 8 hours strapped into a car seat not even able to free itself!! Where is your compassion for the child!! This woman is in the medical profession, the one’s who remind you to always check your back seat. This wasn’t a toy or her pocket book she left in the back seat it was a living breathing human being! Prayers for the family!! What are we praying for, they don’t forget another child in the back seat! This was criminal neglect, plain and simple. Just tell me one thing, What excuse could she use that would justify and make this all okay. Where was God when this innocent child needed him the most!! I won’t degrade his memory further except to let you know that physicians are fallible and make the worst, most frightening criminals due to their high intelligence. Combine it with a broken moral compass, and bad things can happen. Why was Sherlock Holmes’ nemesis DR. Moriarty? What “doctor”(s) directed the covid scam? Have they faced accountability (yet)? Why not?
Doctors can and are some of the best humans on the planet. They can also be the worst. Please don’t rush to judgment. I take a more skeptical view of a physician who abandons her child in a hot vehicle. Hell, there are numerous warnings all over the place, especially in VT, against leaving your dog to such a fate, let alone your own child. Surely a loving physician would know.

If this was a retail store worker or other minimum wage job, no special treatment would be given. It’s terrible and all, but medical professionals shouldn’t be above the law.

She was a doctor, she should have known better. I am sure she took classes learning about this sort of thing, so she could advise her patients. I don’t care about the excuse. All of us have gone to work in a hurry and exhausted, I don’t understand how anyone can forget their baby is in the back seat. She should have at the very least been charged with neglect resulting in death. If any one else had done it, they would have been charged with murder or manslaughter.

I sincerely hope that you never experience a tragic accident caused by distraction, forgery, or any other act or circumstances for which you are responsible. This mother will probably never forgive herself and will always know and be searingly reminded daily that she left her child in the car and he died. She will never escape the torment of imagining how he cried and called out to her for help and then died. If the State does not see a need to press charges, who are we to appoint ourselves judge and jury? None of us can guarantee that we will not suffer through an error of judgment/-our own or someone else’s.
Would this be the case, if it was a man who did this?? I have very little faith in Sarah anyways. She’ll want to praise the Dr for this. BTW, every Dr I have been to with my kids, have told me to look in seats, making sure NOT to leave the baby….
I think a hair drug screen might be appropriate on the mother if that came back clean charges wouldn’t be necessary

Death due to negligence is manslaughter at the very least. There is no excuse for forgetting your child is in the car.
Such a terrible tragedy! My guess is that the two weeks delay for public information rested on the arguments for and against prosecution of the mother.
A criminal negligence case must be filed in court. A child died from careless behavior.
Seems to me that anyone else would have been arrested and charged with involuntary manslaughter. I know it’s tragic and horrible, but why no charges? I don’t believe there would be the same response to a low income undereducated parent who was so harried and distracted that they did the same thing. This Doctor, no matter her education and social status, should not get special treatment.
She is not getting special treatment. She is getting the mercy she deserves after unwittingly and completely unintentionally leaving the baby boy she bore and undoubtably adored in her automobile as she attended to the medical needs of her patients as a dutiful physician.
Her pain is without doubt agonizing & life-long, and others on here appear to be relishing in her agony – which is shameful. She deserves compassion, empathy, & most of all prayers and not a prison sentence.
May God help her. And each of those posters condemning her.

I think you’re onto something Molly. The reality is we all make bad judgements, but that shouldn’t excuse us from being accountable.
Such a sad thing to happen and each time it does everyone tries to figure out a way to stop future incidences. But it does happen again and again. No safeguards in place? Set up a system that if the child doesn’t arrive at childcare in the normal time, they call the parent? Put important things like your purse, one shoe, a lunchbox anything you’ll need before going into work in the back with the child? All sensible things but I guess people don’t think it will happen to them…until it does. My heart breaks for the mom and I hope she has a good support system to get her and her family through this.
It’s a horrible loss for anyone. Living the rest of your life knowing you made a careless mistake is punishment enough.

Thank God we have people like you Michele O who never make a mistake. Phew. You act like she did this intentionally. This is very different than one who get’s drunk and decides to drive and kill. Or worse, one who voted for babies to be able to be killed while they are being born, like EVERY SINGLE DISGUSTING TOWN IN THIS MESSED UP STATE DID. THAT is intentional. I understand that the mother was a pharmacist. What role did pharmaceuticals play in this tragic matter, if any? I don’t think it’s unreasonable to have that question answered.
When children don’t show up for school we follow up with phone calls to the home. I wonder if that’s the case with day cares?
It kind of makes you wonder if this doctor left her child in the car, how many patients she has misdiagnosed or forgot to treat the patients she sees….Yes this was a tragic event but all must be held accountable for their actions….
Tyler Austin & other condemners – I instead ask what is it about the charge of “Negligent Homicide” that YOU do not understand? In order to prove this serious charge – one must be engaging in conduct that they know carries RISK. An example of this would be driving under the influence & crashing your vehicle into a tree which causes the death of a passenger or yelling “fire” in a crowded room causing a stampede that then results in death!
Yet being involved in an auto ACCIDENT where a death or deaths occur is NOT homicide.
Completely unintentionally, inadvertently, yet tragically forgetting that one left one’s offspring in a vehicle is NOT KNOWINGLY engaging in conduct that carries risk. It is a horrible mistake, a tragic error – the type of failures that each of those casting stones here have certainly yet also unwittingly committed many more times than once during the course of their own lives, but only through the grace of God has it not as of yet caused death to oneself or to another.
Life is full of tragedy, sorrow, grief, failures, and regrets – it is the course of human existence along with joys, successes, & happiness. Allow God Almighty to handle this catastrophic misfortune, not you or your neighbors. God promises eternal life & God alone has the ability to transform the worst calamity into good & peace. The premature loss of innocent children occurs daily, and God has only left us with the knowledge that “My thoughts are not your thoughts, and My ways are not your ways”. Let go and let God.
And if you truly wish to attempt to change the trajectory of baby’s lives, try volunteering some time in a pregnancy center and rallying against the INTENTIONAL & MALICIOUS murder of the unborn within this Godforsaken state where the slaughter of the innocent is performed each & every day at a hospital or Planned Parenthood center near you! Or at the VERY least – CEASE entirely from supporting “pro-choice” candidates!

I’ve already been criticized for my 1st comment from someone who is calling me perfect without making ‘mistakes’ which I don’t take personally because I’m PERFECTLY aware that, I’m a Human Being of Sound, MIND, Body and SOUL, who does indeed make mistakes and aligns with Divine Righteousness…….’speaking out’ about Unrighteousness and how this Adult who is within a profession, ‘caring’ medically for others, should be held ‘accountable’. No ONE is disputing that this BABY was not loved or cared for [and hopefully it was] plus we don’t know the backstory of what environmental circumstances has led up to this ‘tragedy’ if we can call it that without all the [f]…actual evidence. What is being disputed, is holding an ADULT Human Being accountable for their negligence/actions/behaviors just as we are asking the same accountability from those ‘officialdom-political-governmental seats’ who also had their skin in the game with all what I dub cvid lunacy; and who have been operating in deception and trickery for eons. Mike Rouelle: The definition I provided is the legal definition of negligent homicide. It was not merely a dictionary definition, or one provided by a search engine. The definition I provided is an example of the standard utilized in a court of law & specific examples were furnished.
But most importantly, the fact that this was the beloved son of an otherwise highly responsible, esteemed pillar of the community and not a woman who was compromised by alcohol or drugs is imperative here. To prove a claim of negligent homicide, it would need to be demonstrated beyond any reasonable doubt that this grieving mother engaged in risky behavior, was aware of the “risk” she was engaging in & that then caused the death of her son. Such is NOT the case.
Again, prayers go out to this poor mother who has been forever deeply traumatized by her completely unintentional error and I can tell you from my personal experience as a practicing Catholic, an individual is incapable of committing a sin (mortal or otherwise) without intent or by “accident”.
I rarely agree with the George Soros-backed prosecutor of Chittenden County, but in this case I do. This mother deserves mercy. The loss of the child which she bore & adored is punitive beyond measure.
Alright Kathleen we’ll settle on child endangerment either way she shouldn’t be able to walk away with just feeling guilty, how do you go a whole day without wondering how your child s day is going, btw you admitted because of her status as a Dr. She should be able able to get away with this if anybody is guilty it would be her who preaches about the dangers of leaving a child unattended in a vehicle. Worried about the law, here is the VT law on child endangerment!!!
Vermont law defines child endangerment as cruelty to a child, which includes:
Willfully assaulting, ill-treating, neglecting, or abandoning a child
Causing a child to be assaulted, ill-treated, neglected, abandoned, or exposed
Causing unnecessary suffering or endangering the child’s health
Failing to provide supervision or care appropriate for the child’s age or development
As a 28 year veteran bereaved mother of a toddler I think it is pretty innocent of anyone to think or say ‘that could never happen on my watch’. It is pure innocence that allows you to believe that the ugly only knocks on someone else’s door. Maybe we should all spend a little more time remembering the times we’ve skated out of a bad situation without bearing the very worst scenario that could possibly of happened. Those times when you said or thought ‘that could have ended so much worse. Whew’. Count your lucky stars. There is NOTHING UGLIER than losing a child.
If the investigators, who have all the details not released to the public, are not finding any value in pursuing criminal charges then leave that family to their own hell. Yes, their life is a living hell right now. They are the ones who have to find a way to live with this horribly tragic accident. They deserve time, empathy and compassion.
