Lawmakers have revived talks on a 2023 bill expanding protections against sexual abuse. Senators passed a new version Friday, shifting it back to the House — though the changes were minor.
The bill, H.40, says if people agree to use protection before or during sex, neither party can remove or tamper with the condom without the other’s consent — a type of abuse called stealthing.
Currently no state law prohibits that deception. The bill would allow survivors to seek damages in civil court.
Vermont laws are far behind in protecting victims of assault, so this bill is important, Sen. Tanya Vyhovsky, P/D-Chittenden-Central, said in an interview.
“We know that this is something that’s happening and we know that consent and informed consent is really important,” Vyhovsky said.
Dana Doran from the Vermont Office of the Attorney General has spent 14 years working with victims of domestic and sexual violence. Many felt they had few adequate avenues to seek support, Doran said in a Senate judiciary committee meeting April 2.
“I’ve heard the frustration that they’ve felt,” Doran said.
House lawmakers passed the bill last March, but time ran out before senators could do much with it. So it was put on hold until recent weeks.
As the bill sat in purgatory, some people worried legislators were ignoring it Vyhovsky said that wasn’t true.
Prior to the bill’s passage, Doran told legislators they should revise vague definitions in the language. Specifically, Doran wanted the bill to define coercive and controlling behavior as a type of assault, she said in the April 2 meeting.
Laura Byerly, director of the Victim Rights Project at Vermont Legal Aid, agreed.
“A survivor of coercive and controlling behavior recently said to me, ‘I figured the only way out of this was either that I would die or he would kill himself, and if he didn’t kill me first, then I would be free,” Byerly said.
But in the end, senators passed the bill without that addition. The amended version approved in the Senate cleans up the House version’s language and updates the effective date to this year.

By the way, (and not directed at KJG.) I took the time to read the updated bill and it does NOT cover tampering with a condom AFTER sex. Only before and during. Thus, as mentioned, stealing sperm from a used condom in order to self-impregnate and violate male trust is not covered. This was so common in the NBA, where women targeted players for high dollar child support extortion fraud, that they issued a warning to players to flush used condoms, and even use them for oral sex. I’m sure the legalese language, like these pregnancies… is not at all an accident.
The backers of the bill obviously forgot to include a provision that a man should have to disclose having had a vasectomy to a prospective mate. No one should be able to shoot blanks without full disclosure. (please pardon my pro-binary references)

Of course the ridiculous thing about a demand for a study is that there’s no way we have reliable data on either point. However, it seems clear that millions of women, despite 20 something options for birth control, get “accidentally,” pregnant every year, never mind paternity fraud, which I would put in the same category. I can’t imagine that millions of men risk STD’s and indentured servitude by _specifically_ removing a condom for which there was express, conditional agreement as outlined in this bill. It’s absurd.

You forgot to mention the part where the amendment says “unless justified by a compelling State interest”.
That phrase makes the amendment meaningless. The 1927 Supreme Court ruling that allowed forced sterilization used the “compelling state interest” argument to justify it.
Today, men will be forced to provide for children, like it or not, because of “compelling state interest”.
By the state definition they did not create a child…..that’s why they can allow abortion up to and including the day of birth.

Women aren’t “doing” anything, their body is just reacting to their sexual act, they have no control over any of the events once a baby is conceived, which is also their sole choice. They don’t “feed the fetus” they have no control over this, unless they decide themselves to stop eating. The us census bureau states that there are 62.5m households in the US with children under 18 and both parents are present.
12.9 m adults in the US receive child support. Not all are court ordered. 80% of those receiving child support are women.So about 10m women receive child support and about 6m of those women receive court ordered support.
So less than 10% of fathers are under court orders to pay child support.

This law is the same law that Sweden used to have Julian Asante arrested in the UK some years ago. It didn’t matter that was unenforceable. It served its purpose.
Julian Assange was arrested in the UK when Sweden requested extradition on the charge of rape. The “rape” charge was based on the accusation that he interfered with the condom during intercourse.
When he was “safely” ensconced in a British jail, the charge was dropped.
That is the intent of this bill.
@vtRocks Yes, the fact that it is logically unenforceable by virtue of the extreme unlikelihood of anything even remotely resembling reasonable proof, indicates that it is either completely superfluous virtue signaling, or, more likely, that it will simply be enforced in the absence of reasonable proof. Especially in civil court, where the burden of proof is basically nil.
