Eliminate right to sue State, lengthen deadlines for emissions reductions, protect families from financial impact
House and Senate Republicans will work together to make significant changes in the carbon-emissions reducing Globalm Warming Solutions Act, Senate Minority Leader Scott Beck (R-Caledonia) and House Minority Leader Rep. Patti McCoy (R-Poultney) said in a written statement today. They wrote:
In 2020 Act 153 (Global Warming Solutions Act) was passed by Democrats and Progressives over Governor Scott’s veto, with every Republican voting to sustain the Governor.
Act 153 was the catalyst for the Clean Heat Standard, which has been widely criticized as unworkable, unaffordable, and revealed for what it is, a carbon tax. We are confident that the Clean Heat Standard will be repealed by the legislature in 2025, voters have clearly spoken.
Senate and House Republicans believe that global warming and climate change is real, and that humans have caused a significant portion of this increase, including 150 years of carbon emissions.
This reality does not mean that we can ignore science moving forward. While science has clearly measured the increase in carbon dioxide in the atmosphere and linked that increase to a warming plant, Act 153 and its goal of zero carbon emissions by 2050 ignores many scientific and technological realities: economics, the limits of alternative energy, and Vermont’s winter climate.
Vermont needs to focus on science. We will propose amendments to Act 153 that establish carbon reduction goals and timelines that reflect the availability and affordability of proven carbon reduction technologies, an appreciation of Vermont’s winter climate and heating needs, and will not cause undue damage to Vermont’s economy or families. We will also move to remove the private right to sue Vermont in Act 153 if it falls short of carbon reduction goals.
Governor Scott was correct in 2020 and is correct today, “We’ll continue to do our part but at a pace we can afford”.

Changes…. That word implies that the “problem” is real. I can assure you, as can thousands of legitimate climate scientists from around the world, the “problem” is totally fabricated. Just another money-laundering wealth transfer from “We the people” to the globalist elites.
Here’s my change fer ya – REPEAL IT!!!

Proposing changes is a typical RINO maneuver. The Progressives take two steps forward and the RINO’s take one step back and then pat themselves on the back while telling themselves what a fine job they’ve done “for the people”. The end result will be the same, it will just take a little longer to get there.
BLACKMAIL, BRIBERY, EMBEZZLEMENT, AND EXTORTION ARE A DIRTY BUSINESS. All house and senate members financial records should be investigated for bribes.
For all the folks who say this doesn’t go far enough, consider that Republicans need at least two Dem senators and twenty Dem Reps to join them in order to pass/repeal anything. If these initiatives are successful in doing that while repealing the lawsuit provision, placing economic restrictions on it that will essentially defund it, and restoring the mandates to goals, the GWSA will be effectively be gutted. That’s a step in the right direction that deserves support. Or, you can overplay your hand, let the Democrat majorities keep those provisions in place, allow CLF to continue with their lawsuits, and watch the courts order ANR to implement a regulatory scheme to meet the ghg reduction mandates on the existing timeline in the law. Two steps forward one step back is preferable to full steam ahead on the GWSA. Another election like the last one and we can repeal it for good. But got to get there first.
No one is ‘overplaying’ their hand, Rob. At least not those commenting on this forum. They’re expressing an opinion, an educated opinion with which I happen to agree, that cutting carbon emissions is not only a waste of time and money, it sets a dangerous precedent.
By all means, amend Act 153. It *is*, at least, a step in the right direction.
But beware of unintended consequences. Act 153, clearly, is loaded with them. But amending Act 153 is equally dangerous. It can (and likely will) be argued that amending Act 153 implies a degree of legitimacy in the Act, when it has none.
For example, the provision allowing private entities to sue the State for failing to meet these absurd standards isn’t the point. It’s ‘the standards’ that ought to be repealed.
What are the unintended consequences I caution about. Well, there’s the 11th Amendment to the U.S. Constitution for one. Additionally, when the provision to repeal the right to sue the State (Vermont) for failing to meet the emission standards is constructed, legislators ought to be careful not to repeal a citizen of Vermont’s right to sue the State for other damages or injuries they might experience.
This is the problem with most laws. They often create more problems than they solve. And, in the final analysis, the only people who benefit are lawyers.
Roper’s warning should be carefully considered by scott and the republican members of the legislature. The GWSA was basically a covert piece of legislation, passed in the 2020 session, under the cover of covid hysteria. An agnostic and ignorant public is still not well informed on this subject, despite all the editorials, comments and articles that appear in less than mainstream media. The major audience media in Vermont are in lockstep with the Climate Evangelists™, still producing lopsided and error filled reports and coverage.
This is the republican legislature and phil scott’s issue to broadcast, shout from the rooftops- whatever is required to get the message out.
A side warning- the internal combustion engine was handed a death sentence this week, by biden’s EPA- California will ban the IC engine for sale in 2035. As Vermont foolishly follows California emission standards, 2035 is our limit also. That’s a mere 10 years to completely restructure transportation in Vermont, upgrade Vermonts electric transmission and distribution system- and pay judgements in lost litigation from the GWSA. There is not enough money in Vermont to be taken by these totalitarian/marxist schemes.
Jay, constructive criticism is always welcome, but when legislators put forward something positive, it is not constructive to attack them as RINOs etc and call for them to be house cleaned. This is counterproductive. Tactically stupid. If you believe cutting carbon emissions is a waste of time and money, every policy change the VTGOP caucus is calling for in their press release is something you should wholeheartedly support. You say it’s the standards that need to be repealed, well, they are calling for the repeal of the standards by removing the mandates that the standards be met. As for the lawsuit provision, anyone can sue the state, but what this bit does is give automatic standing to anyone who wants to sue in regard to ghg reduction goals whether or not they can demonstrate harm (which nobody would otherwise be able to do, because the law doesn’t actually have any impact on the climate). It’s a “sue and settle” clause the Dems put in to allow CLF et al to fundraise off of their bringing the lawsuits while having their legal fees paid for by the VT taxpayer. It’s awful. And a waste of money — something even supporters of ghg reduction can agree upon, which is common ground you need to fight on. So, yes, repeal that provision.
My point, Rob, is that no one is ‘over-playing’ their hand. In fact, they have no ‘hand’ to play.
They’re simply expressing an opinion.. that these proposed revisions are likely not going to be productive. Why? Because the underlying logic supported by the changes remain fallacious.

In the final analysis, do whatever you can, using whatever political gamesmanship there is, to convince the legislature to repeal as much of this Act as possible. But don’t expect all of us to buy into the false logic cited above. CO2 is, arguably, *not* the problem.
This is great and everything, but where is the plan to cut current spending and taxes.
The party better quickly create a formal, believable proposal to cut current spending and taxes. This probably means hiring a consultant who knows how to get this stuff done.
If next election cycle the Republicans only have the repeal of GWSA and no actual spending or tax cuts, they’re finished.
No one is going to want to hear the political speak, we repealed the GWSA that “could have” cost you $XYZ.
Why not repeal it completely? Return to Economics 101. Balance the budget, no more pay raises, no benefits package your constituents can’t have, nor afford. Return to fiscal sanity. Boy, would I Love to be a fly on the wall for those conference meetings.

Saying this “While science has clearly measured the increase in carbon dioxide in the atmosphere and linked that increase to a warming plant…” perpetuates a false hypothesis. The “linkage” of CO2 as the cause of a warming planet has not been proven statistically and can not be true if the hypothesis fails, which it does.
It is important to not fall into the “consensus” trap even when reporting from a position of disagreement. Words matter.

Since CO2 is the lagging variable, it cannot logically be the cause of temperature, the leading variable. It is folly to imagine that by reducing human emissions of CO2, we can change global temperatures, which are obviously driven by other factors.“

I heard consistently across our beautoful State and i firmly believe that the “Global Warming Solutions Act” ought to be repealed. I pledged as a candidate for LT. Governor that I would work to that end, and kill Act 18, the Clean Heat Standard bill.
But first, i am asking Governor Scott to rescind Vermont from the U.S. Climate Alliance membership that he put us in in 2017. That move started a lot of this climate stuff.
There are three (3) groups here; the 1.) United Nation’s Scientist (the IPCC), who have bought in that fossill fuels (burning oil, coal, & natural gas) are bad and causing earth’s warming issues because of CO2 and human behavioral activities. 2.) The “Skeptic” Scientist who believe in some warming activities because of the sun, clouds, the oceans, and variations of the orbit’s relationship to earth. and other affects. They also believe that there is NO evidence that CO2 is the cause. Additionally, there are NO scientific facts or findings that the U.N. Scientist are correct. 3.) The Alarmist Groups, Politicians, and the media that are money greedy haters that want control and money, money, and power for their groups.
Groups 1 & 2 above do have some commonalities, agreements: A. the climate is always changing. B. that CO2 is a greenhouse gas and plant life wolill not exist without it. C. that the globes temperature has gone up 1.8°F between the early 1800’s to 2015, 1°C. D. they agree that no prediction of global temperature can be made or the negative affects on earth or people.
We are already doing the right things for our environment locally and for the Global community. The G.W.S.A. is nothing more than a money and power grab by Group 3, and because the Democrat-Socialist leaders won majorities under the Gold Dome in 2012/2014 and the Governor entering Vermont into the U.S. Climate Alliance in 2017 it has become worse for hard working Vermonters. That is who is being negatively impacted by these Climate Alarmist and their out of control groups.
Lastly, neither Groups 1 & 2, believe fossil fuels will lead to any catastrophe!
Look, I want a clean and healthy environment! We have beautifully clean water, air and environment, Vermonters do the right things every day, because We all want to live, work, and play here too.

It should be obvious – the well crafted, well compensated lie is too profitable to let go. They paid big money for the junk science. They pay big money for the media propaganda. They “agreed” to hand over power to unelected, unscrupulous despots better known as the WEF, WHO, IMF, UN, and charlatans like Billy Goat Gates and George (Jaba the Hut) Soros.
They can’t face the Truth or they simply don’t care about the Truth. The Truth is the “climate change” lie is about depopulation, wealth transfer, and global financial reset. Vermont is being destroyed by enemies of the People. They did it to California, Oregon, Washington, Illinois, New York, etc. They also have brought Germany, France, Italy and UK to it’s knees over this BS.
