An illegal alien who has been charged with the rape of a 15-year-old disabled teen girl has been let go on a modest $500 bail despite a contrary request from the federal government.
Pundits note that the City of Boston’s sanctuary city status likely played a role. Vermont both as a state and some of its communities has similar sanctuary policies.
What happened in Massachusetts
The suspect is Cory Alvarez, he had been held without bail since March when he was initially arrested. He was freed on July 2 by the Plymouth County Superior Court.
This happened despite a request from Immigration and Customs Enforcement (ICE) to keep him in custody.
The New York Post was told by the Plymouth County District Attorney’s Office, “Our office moved to hold a dangerousness hearing and have Alvarez held without bail. The judge denied our motion.”
The New York Post reported, “Alvarez, 26, was released with an ankle monitor, but ICE officials can’t track him because Boston is a sanctuary city — meaning local authorities don’t have to cooperate with the feds.”
Similar to Vermont’s sanctuary status?
According to the Federation for American Immigration Reform (FAIR), Vermont is considered one of at least 11 “illegal” sanctuary states.
“Vermont became an illegal alien sanctuary state in 2011 when Gov. Pete Shumlin (D) implemented a new policy – on the basis of State Police Rules and Regulations VSP-DIR-301 – that was prompted by the arrest of two Mexican nationals after being stopped for speeding.”
It continues that in 2017, Governor Scott signed S. 79, which added local police to those expected to follow sanctuary policies.
The FAIR report continues, “In 2020, as the result of a lawsuit filed by a pro-sanctuary special interest group, the state Department of Motor Vehicles pledged not to report illegal immigrants to the federal authorities.”
Most recently Vermont’s Fair and Impartial Policing policies have been updated in 2024.
The lengthy policy states, “The following do not on their own establish reasonable suspicion of a criminal offense and are not sufficient to warrant an investigation” On this list includes “Limited English Proficiency Citizenship or Immigration status” as well as “Presence in the United States without authorization or formal documentation” and “Proximity to the border.”
According to the USCIS Guide, which is from a private company that does immigration services, Vermont is not currently cooperating with the feds on immigration.
“Vermont is a sanctuary state, meaning that it has adopted laws and policies that protect undocumented immigrants from detention and deportation by providing them with a safe and supportive environment,” it states.
It continues to state, “However, Vermont does comply with federal laws and regulations when it comes to sharing information with federal law enforcement agencies when there is a legitimate threat to public safety.”
In Burlington, there has already been political friction between the federal government and The Queen City.
“The Justice Department is asking Burlington for documents that they believe will show if the city has been cooperating with federal immigration law as part of an escalating, nationwide crackdown on so-called sanctuary cities,” VtDigger reported in 2018.
Vermont sanctuary cities include Burlington, Winooski, and Montpelier.
The legislature’s summary notes that 20 V.S.A. § 4652 is now law via. Act No. 5 (S. 79).
According to the legislature’s summary, this means that “[The] Vermont Attorney General, is authorized to enter into, modify, or extend agreements pursuant to which State and local law enforcement can assist federal authorities in carrying out certain immigration and other functions. However, State and local law enforcement can enter into such agreements when it is necessary to address threats to the public safety or welfare of Vermont residents arising from a declared State or national emergency.”
VDC reached out to Lindsay Thivierge, the Director of Administration for the Vermont Criminal Justice Council. She is away but may update soon about whether what happened in Massachusetts should be a concern for Vermonters.
A national problem
Loose immigration enforcement in sanctuary cities is causing problems nationwide, including in America’s largest city.
The ICE website quotes Thomas Decker, their New York field office director who said, “Let us not gloss over the fact that the vast majority of the individuals arrested during this operation have criminal histories. It’s frightening that New York City politicians created laws that force local law enforcement agencies to release dangerous criminals back into the community despite the seriousness of their crimes.”
They also state the importance of sharing information with feds to mitigate threats.
“ICE relies on the exchange of information with its law enforcement agency partners to access foreign-born inmates at local, state, and federal facilities, and the use of detainers as part of its public safety mission. In many cases, these individuals pose a demonstrable threat to communities.”
The American Immigration Council offers a pro argument for sanctuary status.
It states, “These policies include offering English-language classes; issuing municipal identification documents and driver’s licenses to all residents; ensuring that immigrants have equal access to bail; establishing U-Visa policies to make it easier for victims of crime to obtain necessary documents from law enforcement agencies; and training criminal prosecutors and public defenders on the immigration consequences of convictions and plea deals.”
Questionable tactics by the feds?
The Vermont organization Migrant Justice notes they settled a lawsuit in 2020 with the feds regarding their use of an informant.
The activist organization wrote, “As part of a larger pattern of suppressing immigrant activism nationwide, federal immigration authorities infiltrated the meetings and private associations of Migrant Justice through the use of a civilian informant, invasively surveilled its members, and mined their social media pages for information.”

Now I’m sitting on the edge of my seat waiting to see what occurs when an innocent 15 years old gets raped in this state by an illegal. Between this and the taxes in this state we are looking more like California… a sinking ship.

As I always say Scott is a wolf in sheep’s clothing taking direction from the United Nations via the U.S. Climate Alliance, whose agenda includes green energy and Net Zero, social equity including health equity and real DEI, and open boarders via designating Vermont as a sanctuary state. All of these are agenda items of the United Nations and the Democratic Socialists of America.
Does this surprise anyone?
What we are looking at here is likely just another cultural misunderstanding. When we invite or allow persons from other parts of our diverse world into our midst, we must understand that laws on the books here, like those regarding statutory rape and other forms of sexual assault prohibit actions that may be perfectly acceptable or commonplace in their cultures. It may be our own fault as a society for apparently failing to adequately explain to this newcomer to our land that forcing ones self on a 15-year old girl is not simply frowned upon, but actually illegal here. It may take time for some “new Americans” to fully comprehend that girls and women are not regarded as property and second-class citizens in the US, and so we must do our very best to help them accommodate and adapt to this concept that may be completely foreign to them. If this part of our culture and law was not fully explained to this man when he came here, then we all owe him an apology for the insult and inconvenience of his being treated as a common criminal. We also should hope he would accept an apology from our uncaring media for referring to him as an “illegal alien” since, as we all know, no human is illegal! Understanding, being tolerant of and accommodating the common cultural practices of newcomers to our land is part of us all celebrating diversity and our common humanity!

I hope that was written sarcastically. If they legally immigrated and became naturalized they would know, respect and assimilate to our culture and laws. (Yes Americans have a culture!) When the your very first act in a country is breaking a federal law, why would you follow any other laws. This is on democrats.

This is absolutely disgusting that local and state law enforcement cannot work with federal PARTNERS, especially border patrol or ICE. Every time you read about a rape by an illegal, thank a progressive politician and those who vote to put these politicians in office. Ignorance is dangerous. Insurance companies have the opportunity to raise your premiums in these nice sleepy towns of such nice sleepy states that have low claims. Look around. Third world nations are corrupt, their people impoverished, and certain politicians and traffickers are in cahoots. WelI hate to say it but, women voters generally are much more liberal and forgiving than men. And liberal voters are responsible for sanctuary laws which are unconstitutional, but no one does anything about it especially the spineless republicans here. Nothing will change until the voting changes. The schools have been dumbed down, the media is censored, and social media is not smart on your phone. Morality is gone, manners have disappeared and commonsense is no longer common. But keep voting the way you all are. Doing the same thing over and over expecting a different outcome is the definition of crazy and the Vermonter voter is either woefully uninformed, crazy or both. For your information, I ran for office twice in Vermont. Now in my 70s I’ve paid my dues many times. The facts are that even the republicans in Vermont are now like the democrat party of old. If you are in the mood to shame or lecture perhaps you could look in the mirror. I owe society nothing and my opinion is my opinion. I want more republicans in Vermont but, not the type that vote for Joe Biden. Or the one’s who recently made a big plash for Nikkie Haley here in our primary. Our republican Gov. voted for Joe and told us he would be good for America.
Is this Soro’s “restorative justice”? I want to puke. What if that was the judge’s or DA’s daughter? We were warned about these times.

It’s just astounding especially as the alleged rapist does not belong in this country at all. I don’t know Vermont’s bail situation, but in some blue states he may get let out without any bail.

We all ready see the results – how many dead bodies are piling up in the State? How many police blotters showing chaotic violence daily – assaults on elderly and young alike? Give a rousing round of applause to our Legislature and Administration for allowing this mayhem to ensue with impunity in our once “safe” Vermont. It is no longer “safe” and it is no longer immune to the ills of a society gone haywire. Fortify your homesteads, head on a swivel, and don’t take for granted that at any moment, you or a loved one will be the next police blotter entry courtesty of these foul beings lurking in our communities.
…and keep in mind that our democrat-majority legislature has also diminished our capacity to defend ourselves from the scum they have allowed to run wild by imposing:
-background check requirements for transfers to other than family members
-a 72 hour waiting period to receive a firearm from a dealer after purchase.
-so-called “safe storage” requirements when children or prohibited persons may have access
-restricting sales to those 21+ years of age
-magazine capacity limits
And just to add some irony to that situation…you can read the details of those restrictions on the website of the Vermont Department of “Public Safety”…

In 2007, I was a bartender in Burlington and remember a rape that occurred on Monroe Street after the bars closed. It was stopped by four men in a passing vehicle. The attacker was some refugee from an East African country who followed her home directly from Red Square. Rather than tarnish the Refugee programs’ reputation, a Chittenden County judge plead down the charge and gave him 364 days prison to avoid deportation. That man is still a Legal Permanent Resident here (who votes locally now).
