Religious freedom an excuse to oppress transgender people, state policy analyst says

The state’s Racial Equity Policy & Research Analyst this week told a Senate committee that Freedom of Religion can be used as an excuse to deny human rights. His statement suggests religious rights will be overshadowed by other civil rights if Proposition 4 passes the Legislature and is approved, a critic of Prop 4 said.
Proposition 4 reads:
Sec. 2. Article 7 of Chapter I of the Vermont Constitution is amended to read:
Article 7. [Government for the people; they may change it]
That government is, or ought to be, instituted for the common benefit, protection, and security of the people, nation, or community, and not for the particular emolument or advantage of any single person, family, or set of persons, who are a part only of that community; that the government shall not deny equal treatment and respect under the law on account of a person’s race, ethnicity, sex, disability, sexual orientation, gender identity, gender expression, or national origin; and that the community hath an indubitable, unalienable, and indefeasible right, to reform or alter government, in such manner as shall be, by that community, judged most conducive to the public weal.
The startling comments by Racial Equity Policy & Research Analyst for the Office of Racial Equity Jay Greene, who identifies as transgender, came as Renee McGuinness, Vermont Family Alliance Policy Analyst, testified about Proposition 4 February 20 before the Senate Judiciary Committee. VFA is a parental rights and minor protections advocacy group.
McGuinness noted that religion – included in the original draft of Proposition 4 – is intentionally excluded. It was repeatedly claimed during the Committee meeting on January 30 to be “already covered” under Article 3, Chapter 1 of the Vermont State Constitution. McGuinness claimed the language in Article 7 would be amended in a way that would create a hierarchy of rights, interpreted under strict scrutiny by Vermont State courts.
Specifically, Prop 4 would oppress the rights of persons and groups practicing Judaism, Christianity according to the Gospel of Jesus Christ, and Islam to live, speak, and act according to their beliefs without the threat of a legal suit against them if their believes, statements, and actions are perceived by a member of a State-sanctioned ‘marginalized’ protected class to violate their rights, including the state-protected person’s right to “dignity”, which is undefined in the Purpose section of Proposition 4, McGuinness said.
Persons practicing Judaism, Christianity, and Islam would be marginalized by intentionally excluding “religion” as a protected class – despite the fact that all three faiths (and others, of course) have been been historically marginalized.
Jay Greene, Racial Equity Policy & Research Analyst for the Office of Racial Equity, pointed out that some individuals identify under several categories of protected classes, and therefore qualify for more protections and benefits under the proposed amendment.
Greene stated, “Repairing historical harm sometimes requires equitable treatment, not equal treatment, and equity sometimes means targeting programs to populations based on need rather than absolute equal treatment,” that religion is protected under the First Amendment of the United States Constitution, and according to his personal opinion, not necessarily the opinion of the Vermont Human Rights Commission, “I have concerns with some people using ‘freedom of religion’ as an excuse to deny the human rights of people like myself, transgender people and other people of the protected classes that are listed in Proposal 4.” This is a clear statement that Jay Greene thinks his rights supersede another person’s right to live out their faith and is a foreshadowing of the State laws and policies we can expect if Proposition 4 were to pass.
The comments were part of a lengthy discussion about the impact of Proposition 4 on civil rights, and especially freedom of religion, including testimony by McGuinness. VDC will continue to follow this important news story.

Thanks, Guy Page, for your on-target critique of Prop 4. What a shocking admission by Jay Greene, that his transgender identity should place him in one of the elite “protected classes”—protected, we assume, from us big bad “religious” voters who would force America to be Christian by a 51% vote. (Even if that were our intention, which it isn’t, don’t hold your breath.) An irony that Greene doesn’t get is that his position comes from an ideology, a worldview —a religion!—with its own cadre of secular prophets and high priests. I do not share his religion or like it, but I can allow him the legal freedom to practice it. I am not confident that he would do the same for me. And please, let’s remember to pray for Jay and others like him. If God showed mercy to me in Christ, he can do the same for anyone.
Mercy requires repentance and turning away from sin.

Why does Vermont, of all places, have an office of “racial equity”? Presumably because of all the white liberal guilt, for example all of the BLM flags at high schools in Vermont. Anyway, the office of “racial equity” needs to be ended so Vermont can save some money.
This proposal would mean that even Christian schools would be forced to allow males in girls’ bathrooms and locker rooms and on girls’ sports teams or be sued by the state. It’s truly dangerous legislation.

Again, so sorry Chris/Mark – The United States Constitution forever PROTECTS the right to Religious Freedom as endowed by our creator – it does NOT protect any twisted “right” to force anyone to surgically alter/provide medical assist in some feeble attempt to alter sexes – a physical impossibility. Who might this “everyone” you speak of be? No one would demand that you become Christian or Jewish, etc. and believe its tenants. Yet you somehow feel it’s okay to demand that I, not just tolerate, but accept your beliefs in Trans/LGBTQ/Pronouns and demand that I use your pronouns and acknowledge your trans status through the coercive force of government power.
It is really the United Nations who claims that trans and LGBTQ+ rights come before religious rights. This is because a small business owner can deny to make a wedding cake for a couple based on their religious beliefs. The UN has been tracking US supreme Court cases on this issue. The United Nations is the catalyst for everything that occurs relative to education and legislation in this state. They drove the trans agenda with the World Health Organization.
Which “guy” is saying what “polite society” already believes? If adopted this amendment does indeed further establish protected classes of people- that can vary dependent upon prevailing political winds. As an example, are a gender dysphoric individuals rights greater than the rights a female has? Both are considered “discriminated” by your “polite society”. Your right to any religious view you choose- including humanism- is enshrined, but should you be able to force a devout muslim to cater your event, serving pork? This proposed amendment says yes, if you are a member of a specific en vogue class. The concept of a hierarchy of rights for ‘protected classes” is anthesis to Vermont’s Constitution currently.
I think we should go with the popular opinion – kind of like the progressives’ popular vote. There are more people who identify as religious in America, than as transgender. Religion wins. I find it odd that someone would want me to recognize their basic rights, while attempting to eliminate mine. If you won’t recognize my beliefs, there is no way I will recognize yours. It’s a conundrum isn’t it.

Hi Chris – speaking for myself only, I don’t want any transgender people getting beat up, etc. and would strongly oppose anyone doing so. My concern with the implications of this amendment is people of faith being compelled to hire transgender teachers for their religious schools, people who don’t like using preferred pronouns being compelled to use them, students being required to write essays supporting a lifestyle they believe is sinful lest they get an F, etc. I agree that religion can and has been used as a club. But so can ideologies opposing religions. Both should have no place in American law.
Guy – I’m happy to hear that you don’t support transgender people getting beaten up, but a transgender 16-year-old in OK just died after being assaulted by other students and that’s what the hatred expressed in these posts leads to. Why are religious people so fearful of anyone who doesn’t conform to their idea of what a man or woman is? It’s obvious sexuality is on a spectrum. It’s obvious that rigidly defined roles for men and women is oppression. And what’s so hard about addressing a person by their preferred name/pronouns – it seems like a basic courtesy to me and I fail to see how it infringes on your religious freedom.

Chopping off body parts does not change your DNA, taking hormones does not change your DNA. The American Psychiatric Association hasn’t considered being transgender as a mental disorder since 2012. It could be argued that transphobia is a mental illness. Are you a psychiatrist?

But at $7.2 Million per trans person in surgeries, hormones, and THERAPY, it’s not difficult to explain the APA’s (and UVMMC’s) lack of curiosity regarding these high-quality longitudinal studies.

A critical note is that the Senate Judiciary did not review the Purpose Section of the proposed amendment during the Walk-through on January 30: the purpose section explains the intent, and discussions in committee provide intent for legislation if the people pass Prop 4, which is to roll out benefits and programs for state sanctioned ‘marginalized’ groups at taxpayer expense and provide stronger protections for protected groups because they didn’t like the SCOTUS decision on the Harvard and NCU affirmative action. This means if Prop 4 is passed, we can expect laws on making sure no one’s dignity and respect are violated, and State courts will decide discrimination cases based on these laws. Senator Vyhovsky attempted twice to compel me to call Jay Greene by his preferred pronouns. I told her I don’t do compelled speech. When people vote on Prop 4, they will not know or understand that tax dollars for reparations and equity programs will follow, because although under Article 6, Chapter 1 of the State Constitution, officers are accountable to the people. They used to disseminate information about proposed legislation to the people. I can assure you they have no intention of educating the public, just like Prop 5/Article 22. You see where this is leading . . . It’s a runaway train on every issue at the State House this year.

Dr. James Lindsay and others in academia actually wrote a series of academic papers call the Grievance Studies, which were submitted to education/academic journals to see how far the critical theorists in academia were willing to go. The paper argued that white children should be chained to their desks so they could experience the reality of slavery. The paper advocated that these chained students would be treated compassionately. The feedback he received from the reviewers was that the children shouldn’t be treated compassionately. The justice on Social Justice doesn’t apply to everyone.

Consider, again, the infamous Milgram Experiments in 1963, characterizing ‘teachers’ and ‘learners’.
In the autonomous state – people direct their own actions, and they take responsibility for the results of those actions.
In the agentic state – people allow others to direct their actions and then pass off the responsibility for the consequences to the person giving the orders. In other words, they act as agents for another person’s will.
However, the “teachers” (the real participants of the study) believed the shocks were real, which was crucial for the experiment to measure obedience to authority figures even when it involved causing harm to others.

The ‘spirit of the law’ (Constitution and Amendments) is considered in court decisions – the history, context, and intent. The spirit of the Senate Judiciary and the 23 Senators that sponsored the bill, with Senator Virginia Lyons as the lead sponsor, is indeed to oppress the religious, most specifically those that worship the One True God, and to collect tax dollars for programs and benefits exclusively for protected classes. Historically the spirit of intent of Article 7, Chapter 1 is that, “social and political pre-eminence would reflect differences of capacity, disposition, and virtue, rather than governmental favor and privilege.” – Baker v. State of Vermont decision
Prop 4 also violates the spirit of the law, Article 1, Chapter 1 of the State Constitution, in that the spirit of this article is active pursuit of happiness through work and merit, not through State-sanctioned benefits and programs.

This is unconstitutional. End of story. Nothing any state can do to override or diminish or alter the US Constitution. Take it to the Supreme Court and REMEMBER: As per the United States Supreme Court:
The US Constitution is the SUPREME law of the Land.
An unconstitutional statute – though having the name and form of law is in REALITY no law but is wholly void and ineffective for ANY purpose.
Therefore, an unconstitutional law is INVALID. And since it is invalid, it:
IMPOSES NO DUTIES
CONFERS NO RIGHTS
CREATES NO OFFICE
BESTOWS NO POWER OR AUTHORITY OVER ANYONE
No one is bound to obey an unconstitutional law & no courts can enforce it.
Any history teacher you may know is well aware of this.
“Trans people” are already protected under the Americans with Disabilities Act and other civil rights law since, except for a small percentage who have a legitimately recognized gender dysphoria, they typically suffer from a spectrum of serious mental maladies, such as forms of identity and dissociative issues and delusional disorders as well as an obsession with perpetual victimhood that is pretty much universal among leftists.

What, huh? How can the people or nation as a whole benefit when it is the distinct communities listed who judge the outcome? What about conflicting interests? How is a community defined? What separates it from a “part of a community”? Yes, I believe so. These types of policies are systematically being implemented globally. Ireland just implemented a law that police can go into people’s homes and search their computers and mobile phones for content deemed as hate speech. This includes unread emails. The law assumes you will read and share the information. Therefor, the police can arrest you. We had three pandemics during COVID-19 according to the UN and World Bank; COVID-19, hate speech and systemic racism. The World Bank provided money to combat all three pandemics.

Wow – how refreshing for me to see Vermonters rearing up amicably discussing for the most part a contentious topic narrative that was installed by what I call the ‘overlords’ ‘watchers’. In my perspective, what these overlords have done, is weaponized words which in essence is causing extreme division amongst Human Beings. We are so occupied to look at the surface meaning of words that in most cases don’t see beyond the word and what intentions and/or ‘lack of transparency’ there is. We continually keep using all sorts of words to define our Human Being species and then try to jam everyone into these compartmentalize boxes while justifying all these behaviors. Human Beings keep playing right into their hands. It’s like a poker game. I would suggest for those who are not aware of how poker is played, look it up. Why do we keep forgetting or rearranging what was written so long ago regarding ‘inalienable and inherent’ brought forth from the ORIGINAL INFINITE CREATOR and not the imposter false GODs who created ‘mankind in their image’? WE must stop segregating the Human Being species by any form of color, gender, disability, or what religious belief they are or follow. Most Human Beings are inherently good natured with good intentions without wanting to cause harm onto others. We can’t keep utilizing all our doctrines and edicts to justify changing ‘words’ to suit Human Beings who change their gender for whatever reasons and then believe they are entitled to some kind of different preferential special treatment. Why Why Why – What does changing gender represent under the defined terms of an authentic organic Human Being? We have two genders [female and male] period – and until we see physical proof walking fully amongst us that represent Transhumanism and Extraterrestrial, then and until then, we must stop OBFUSCATING and DISSECTING the Human Being Species into the laundry list of bodily attributes and religious beliefs that define us to perpetuate separating us into suited skewed – slanted – slighted manmade laws that are indeed promoting ‘superior-ism’ and a monarchy system. This is not healthy. We claim we have a United States of America Constitution in place but what’s the point of having this or any State Constitution when we keep dismissing and changing/altering their original intent of why they were created in the first place. Furthering to say, if we have that much of a challenge to have Human Beings in these ‘so-called elected seats’ that keep catering to the negative consortium noted above, which subtly coerce, manipulate or even blackmail, to follow such means to violate said edicts, then maybe the Human Beings who call Vermont America their home need to remind ourselves of the edict noted below we have in place and perform the poignant words written so long ago. Furthering to say, if we can concede that we are indeed Mature Human Beings who can co-exist under the Cosmos benevolently on this planet without all these heavily regulated nefarious ill-intended laws policies, procedures, acts and statutes; crafted and promoted by ‘pirate criminals’, than we need to fully discard and remove any structures that represent and/or are tethered to governments and monarchies and put something completely in place that represents a ‘Universal Common’ Representation that is Human Being user-friendly across the board. This “improvement” will have the opposite effect. DO NOT FORGET, freedom of religion was the keystone of America and must be kept intact. Religious persecution cannot exist where freedom of religion is guaranteed! Political persecution cannot exist where there are no democrats.

Quakerism is one of the pacifist expressions of religion. Quakers were persecuted because they were not willing to go to war with their neighbors. In 1677, William Penn drew up Concessions and Agreements for the settlement of Southwestern New Jersey. This is one of the most important founding documents of which most Americans have never heard. It is regarded as a precursor to the Bill of Rights. It even recognizes more rights for women than the Bill of Rights. One hundred and fifty men, mostly Quakers, signed with Penn. Among them were a Matthew Allen, Thomas French, John Payne, Thomas Stokes, and Robert Zane II. I know a little about these five because they are all in my family tree.
Proposition 4 is a call to amend the Vermont Constitution to extend protections to people on several grounds. Religion has been intentionally left out of the list. This is not the first time New Englanders have been intolerant of religion. In the Boston Bay Colony, Quakers were brutalized, imprisoned, fined, deprived of food, strip-searched, charged with witchcraft, expelled, or hung. You can see why my ancestors thought New Jersey was more promising than New England.
I’m not a Quaker and I disagree with a lot of the ideas of some of my ancestors, but we all have a right to our expressions of religion. Freedom of religion is the very first concern in the Bill of Rights and the U.S. Constitution has preeminence over state laws.
Being anti-Quaker is not much of a thing anymore, but Vermonters do not support anti-Semitism, Islamophobia, or other forms of religious intolerance. Vermonters and our legislators should see through this intentional exclusion and reject Proposition 4 if it rejects religion.

Governor Abbott told the United Nations activists to go pound sand, while Vermont bent the knee and removed religious exemptions in service of the United Nations. Texas if looking better and better every day! This doesn’t surprise me as Vermont politicians are being paid to implement the agenda according to a government watchdog dog group. Texas wasn’t on the list of states receiving money, like Vermont.
