The New Hampshire Supreme Court has ruled that police improperly obtained cell phone location data for Logan Clegg during a search for the suspect in a 2022 double murder in Concord, New Hampshire.
Logan Clegg was convicted of killing Steven and Wendy Reid in April 2022. Police searched for months for the killer before Clegg was arrested in Vermont in October 2022 after authorities tracked him down in a Burlington public library.
Clegg is a former employee of a Burlington grocery store, according to other news reports.
New Hampshire Public Radio: “In a unanimous but unsigned opinion, the court’s justices said that Concord police detectives violated Clegg’s constitutional rights against unreasonable searches when they failed to obtain a warrant before contacting Verizon for cell phone location and text data. Police said they were concerned that obtaining a warrant could lead to delays.”
A jury convicted Clegg in 2023. He was sentenced to 100 years in prison. He remains behind bars pending further legal proceedings.
The court has ordered a trial court to consider whether police could have obtained the cell phone location data through another avenue. The NH Supreme Court will eventually determine whether Clegg needs a new trial.
