Constitutional amendment protecting gender identity and expression has public hearing today

A proposed Constitutional amendment “to specify that the government must not deny equal treatment and respect under the law on account of a person’s race, ethnicity, sex, disability, sexual orientation, gender identity, gender expression, or national origin” will be the subject of a public hearing this evening at the Vermont State House.

The Vermont House Committee on Judiciary will hold a public hearing on Proposal 4 Wednesday, May 1, at 5:00 p.m. in person in the House Chamber or videoconference (Zoom webinar).

The hearing will be available to watch live on YouTube. Renee McGuinness of the Vermont Family Alliance is expected to testify in opposition to the amendment in House Judiciary this morning.

The proposed amendment has passed the Senate. If approved by the House, it must also approved by the next Legislature, then put to a statewide referendum vote.

The Committee will take testimony on the proposed constitutional amendment at the above date and time. Testimony will be limited to the first 30 registrants, and registrants will have up to 3 minutes each to speak.  Anyone interested in testifying had to sign up in advance of the hearing through the following online form: https://legislature.vermont.gov/links/public-hearing-prop-4 no later than May 1, 2024, at 12:00 noon.

  2. “Gender Identity”…..why not Species Identity – or Planetary Identity? Could that be next? Assuredly so. And can employees be threatened with job loss in VT because they refuse to accept their mentally ill co-workers’ assertion that they are from “Planet Screwball” or because they refuse to recognize biological realities?

    Mental illness is mental illness, and compelled speech is a violation of Freedom of Speech to which we are all entitled. Legislate what you “choose” to (we realize you adore “choice” when it benefits your cause), but the fact remains that when any local/regional/state law violates the US Constitution, a citizen is neither obliged or expected to be in compliance.

    So sorry, Mr. Taylor Small.

  3. This is clearly going to cause a major clash of an individual’s subjective view of themselves and the world and the rest of the world’s objective view of reality. Enshrining make-believe in the state constitution is a recipe for disaster and gives far too much weight to this mental illness (gender dysphoria) and too much potential for erasing the protection of women/girls and their spaces.

    • There truly is a war on women and it is being promulgated by the left and their solidarity with Muslim extremists. Without doubt, the goal of radical Islam is to annihilate the western world and with-it Jews & Christians. This is currently being enacted through both word and deed while being encouraged now by the democrats & progressives who openly & vocally embrace their party’s extremist faction of “newcomers” from the Middle East – like the members of the “Squad” & their electorate.

      Radical Islam believe a female life is lower than that of “beasts of burden”. Isis & their Sharia Law routinely murder women for irrational & meaningless infractions, they kidnap & sexually enslave & brutalize them, and countless peoples from those regions participate in the act of childhood female genital mutilation to ensure that women never derive any sexual pleasure.

      The goal of the extremist portion of the democrat party is to force Islam in the West and install Sharia Law worldwide which oppresses and violates the human rights of females, among other horrors. This is being accepted & tolerated, if not encouraged by the U.N. and removing biological females from athletics here in the USA & allowing men to displace them and invade their once personal spaces is but the beginning of targeting and subjugating ALL women.

      When the Supreme Leader of the Islamic Revolution unequivocally states that women must forever be subservient to men and must strictly adhere to these “laws” that dehumanize & persecute them, BELIEVE HIM. Coming to a country near you……

  5. I am a State House observer and the first I heard about a public hearing way a day ago. And now the cut off to be able to testify is past…..already!? Expect the hearing at 5:00 to be a one-side zoo…..

  7. The denizens of Montpelier who identify as Democrat/Progressive will enshrine this fantasy if they can. If they are not kicked out by raional voters in the fall, they will turn to protecting other species and those who identify as other species.

  8. Enshrining fiction in the VT Constitution? How foolish and destructive is that? Adding this to the VT Constitution is just as stupid and ill advised as the recent enactment of the hate speech law in Scotland that opened the floodgates for all kinds of legal complaints and lawsuits.

    Concerning sex, there are two; male and female. Wearing pants or a dress, taking meds or having surgery is a voluntary personal decision and the consequences are not the responsibility of anyone else unless it involves breaking the law. The state can’t prevent people from making those decisions and isn’t responsible for the consequences. The Individuals making those decisions have that responsibility.

    The U.S. Constitution states: “We hold these truths to be self-evident, that all men are created equal, that they are endowed, by their Creator, with certain unalienable rights, that among these are life, liberty, and the pursuit of happiness.” That covers everyone, and there are laws that cover discrimination. And “national origin”? Are they serious? We are a nation of immigrants and I’m sure the founders were aware of that.

  9. The senate already passed this make-believe bill. Everyone in the USA is already covered under discrimination laws but Vermont’s brainiacs need to pander to the very small community of voters who believe they are something other than what their chromosomes say they are.

    They are famous for saying follow the science except when the science proves them wrong. As we can assume with this crowd of make-believe representatives that it’s about feelings, not facts.

    As an American, I personally don’t really care what you think you are whether you are a Furry, a wolf, a tree hugger or anything imaginable. The problem is that encouraging mental illness is a huge mistake of the reality and an abomination to the real rights in our constitution that are ignored by this same group.

    You see, that with progressives the only constitutional rights they recognize are those which go along with their ideology. These are the same types of people who should not be in government positions to alter your and my life with their disrespect of the true science that says that a man is a man, and a woman is a woman and playing make-believe with our constitution should not be allowed by the voters.

  10. Religion was added to the protected group in the Senate Judiciary Committee, although, House committee members are very concerned religious protection exists. I hope you listen to the conversation surrounding religion.

However, the amendment excludes religion as a protected class — this state will continue to target people of faith, and this amendment will help them weaponize gender pronouns. Do people know that DCF agents prevent Christians from adopting or fostering children solely because they may not “affirm” gender dysphoria? Perhaps by the time this referendum comes up Vermonters will have learned how terrible this is for children — the rest of the world is waking to the evils of wokeness: Vermont will likely be the last instead of first to wake up. We have the villains on the record though…..

  13. We live in times of a war on women and a war on Judaism, and the liberals of those demographics are predominantly on the side of their adversaries. This proposal will come square up against the US First Amendment’s religious protections, that currently trump statutory and civil public accommodation laws according to most court decisions.

  14. Yes, thank God for the 1st amendment but the progressives have a war on God and children too. Children need protecting from being lied to about their ability to change their gender anytime they want to without parental consent. They are not God yet they are being told they are. Even the parents are being lied to if they believe their child can change genders and back again without life altering consequences like poor body image, mental health problems including depression and anxiety, sterilization and because of a VT law you cannot sue the provider for any damages. I say you can sue them if they were lied to!!! Challenge that law!!! They sterilize young people and it’s protected?? I don’t think so!! The people who are to blame are the progressives. I hope and pray that there is a huge turnover of representatives this fall in November from progressives to republicans. Please make it happen.

  15. As I learned from my contact with Marina Brown and others in the radical eft there are also ways to rig voting. E.g.: Outside people who are registered in multiple locations.

    You see how the corporation lawfare warfare subverted our constitution for generations? They continue to paper over it, ignore it, and crucify it. They will stop at nothing to ensure they have corrupted and overtaken all that was ours to begin with in 1793!
